Nifong a Topic at State Bar Council (and Feds Decline to Act for Now)

This week Durham District Attorney Mike Nifong could be slapped with more charges related to his handling of the Duke Lacrosse case.

This week the State Bar Council will be holding its quarterly meetings in Raleigh. During this time, the agency could add ethics charges against the Durham district attorney.

Nifong recused himself from the Duke Lacrosse case shortly after the state bar filed an ethics complaint against him last month. He's accused of misconduct for statements he made to the media last spring.

In a letter obtained by Eyewitness News, defense attorney, Joe Cheshire requested to meet with Nifong in March about the statements.

"I do not understand why you will reportedly speak to the media in such certain, condemning terms before all the evidence is in, but you will not have the courtesy to meet or even speak with a representative of someone you have publicly condemned," Cheshire stated in the letter.

Nifong could also face additional charges for withholding DNA evidence that was favorable to the accused players. Evidence that is now in the hands of the state's Attorney General.

"We accept these cases with our eyes wide open to the evidence, but with blinders on for all other distractions," Roy Cooper said.

The State Bar Council meets today.

The council will decide this spring if his public comments about the case were a violation of the professional rules of conduct. Nifong's ethics meeting is scheduled for May.

No Federal Probe

The U.S. Attorney General's office has responded to Congressman Walter Jones' request for a federal probe of the Duke Lacrosse Case.

In a letter delivered Thursday, Alberto Gonzales' office wrote that it would be, "Premature to initiate a federal investigation pending a criminal trial."

This means the Attorney General will not be getting involved in the case at this time.

Oh man, that is so funny! LMAO! That's like asking of a police department, of the thousands of cases investigated by the Department, how many cases got the Chief involved. I have to stop now, I've got tears in my eyes.

Yes, it was you who posted about the interesting timing of all this: Nifong recusal, NC Bar getting involved, and Feds backing off (perhaps, for the moment).

Tells me there's LOTS of eyes following this case, at all levels.

They dread having a layer of oversight imposed on them. Mikey is blowing it for all of them. NC gives DAs a sweet deal, and Mikey is the rotten apple seen to be spoiling their barrel of fun and free rein.

I didn't say that they were. Perhaps you need to bone up on the difference between an FBI investigation and a federal prosecution.

No you mentioned only FBI investigations not cases developed from those investigations. Most of them ended rather quickly with "nothing of federal interest here" reports.

Given the weakness of your arguments it is easy to see why you FEEL fed involvement would be atandard.

Well, an FBI investigation is a Federal investigation, and a Federal Prosecution is a Federal Prosecution. The difference is, one is federal and the other is federal.

--what upsets me is all the media journalists (whores) who are falling all over themselves to give Nifong every excuse in the book. (just one time, his first big case, never was bad before) --

Wasn't it ABC that updated the audience many times during Sunday about their 20-20 report of the Nifong case falling apart?

The only one that may apply is " false arrest and fabrication of evidence.;" But the arrest was based on a complaint filed by a private citizen, not a covered official. Yes, we can argue that the citizen's complaint was false and that Nifong simply used that complaint to further his political ambitions, but there is no evidence he initiated the complaint and under the terms of federal policy, this in my opinion would not open the door to the Feds.

That is my honest opinion. This is not a Federal case --- yet. If it actually gets to trial and one or more of those guys were convicted, then it could well be within Federal jurisdiction.
