Senate balance pivots on ailing Democrat (Johnson)

Johnson spent his 60th birthday last week in the intensive-care unit of George Washington University Hospital, where he has been in critical condition since emergency brain surgery Dec. 13.

He has not spoken since the surgery, said a spokeswoman, and he remains on a ventilator at night.

Johnson is up for re-election in two years, but until then no authority can remove him from office.

Should Johnson die, however, all eyes would be on Gov. Michael Rounds of South Dakota. He is a Republican, and would be under pressure to name a Republican to the Senate seat - thus giving control back to Republicans.

OMG, Dr. Deshmukh is one of the doctors I had in March 2004 when I was at Barrow Neurological Institute when I had my carotid artery dissection! You don't forget a name like that. He was a really good doctor, and the only one who really explained to me exactly what my condition was, even drawing me a little picture.

To the extent that his faculties prevent him from declaring his mind and speak his intentions, he is.

Now, were he my dad, I would tell both parties to take a flying leap, so to speak.

But, thinking about the US Senate and the American voice and intention, as expressed by South Dakota, along with all of us, this is a mockery of governance. Dim or Pub, this says to me that all those powerful people, all that marble and granite, are denying full representation because someone is so ill that he cannot even take the oath of office. However, if this is how the Dims 'control' the Senate, by ignoring the man behind the curtain, so to speak, their absurd hold on power is a chimera, and a sham.

Weekend at Bernies being played here? If a right wing senator had this happen, the left wing congressmen would be screaming to know all the truth about the congressman's health in order to allow legeslation be done in order for the childrens sake. But the weakened pub party allows the dems to run the show and so more injustice is done by the politicians who hate God, family and country.

I wonder if the Dems would try to get a bill passed that would require a governor to appoint anyone taking the place of a member who can no longer serve,from the same party the congressperson they are replacing is in.

Can Rounds appoint himself and then announce he's running for the Presidency and end our nightmarish slate of Rino candidates heading to slaughter??

If the seat is vacant there is nothing that prevents him from appointing himself.

It is contrary to common sense. Amend the constitution to Declare him incapacitated and hold an election.

That would take two-thirds of the senate and three-quarters of the states.

Secondly, under the Constitution, no state can be denied their representation which, if SCOTUS says so, might REQUIRE the Senator to be replaced.

They aren't being denied their representation. South Dakota has two senators.

So we should expect to see him more often on Sunday morning talk shows. My money is on Chris Matthews; that way, Chris would never have to pretend that he will wait for the guest to answer the question, he can just keep making one huge question out of the entire show.

Hmmm, interesting point of order. Most laws require a MAJORITY of votes to pass. With Johnson absent, and a straight party line vote, that would still fail to meet the majority requirement and would this fail to pass.

A majority is anything over half the votes cast.

Oh,so very true, the hypocrisy of it all. And the do nothing but yammer Pubs wonder why the true conservatives hate them as much as the liberal communist left politicians?
Or perhaps they believe the base of the right wing conservatives, Christians for those who live in Rio Lindo, are as ignorant and as foolish as the left wing base is. They have yet to re-discover that bible Christians vote biblical morals over political immorals everytime. Only religious christians would stand for the immoral rino party as it is today

If Senator Johnson can't vote, the state of South Dakota has the right to relace him with another senator who can vote.

Have you seen a single report from any doctor treating him that says Johnson is in an irreversable coma? Have you seen any report from any doctor treating him saying that he will never recover his ability to speak or communicate? Any reports from any doctor treating him saying that he's brain dead? Any report from any doctor treating him that says anything other than the long term effects are not known at this time? Neither have I.

So how long would you wait before replacing him? He was stricken on December 13th, would you have replaced him on the 14th? It's been less than a month. Would you give him a month? What if you replace him tomorrow and in a month he's talking and within 6 months he's able to resume work? What then? "Oops, sorry Tim. But we were so anxious to grab your seat that we assumed that you were dead. We bad."

So how about defining it? Who's judgement would you use? How long do you give it? And what if you're wrong?

If there had been one more Republican member in 2001, Jeffords wouldn't have had the opportunity to jump and put the Republicans in the minority.

The Republican majority could also have been maintained had Connie Mack (R-FL) not retired and left an open seat that was taken by a Democrat. Some suggest that Mack would easily have been re-elected, after which he could have retired and replaced by the Republican governor. Retaining Mack's seat would have further discouraged Jeffords from defecting.

With an open seat, can Cheney be brought in to cast a vote as Senate President? Sine it will in effect be 50-49 the open seat means the possibility of a tie.

Funniest thing to think about. Rangel through Cheney out of his office and took it over. Can't wait to see Cheney telling Rangel & staff to pack up and get out.

He still represents his state. Many Senators fail to show for votes.

His state is now incapacitated, politically, just as West Virginia is when Senator Byrd slips in and out of dementia.
