Military salute at cemetery leads to arrest (San Mateo, CA)

A 38-year-old man read aloud from the Bible and fired a handgun twice at the base of a flagpole in Golden Gate National Cemetery to honor soldiers on Christmas Eve, according to prosecutors who charged him with six felonies.

Maurito Alviar, 38, of Oakland, told authorities after his arrest he was very upset with how the country treats members of the military and hoped to pay tribute to them by conducting his own version of a 21-gun salute, said Chief Deputy District Attorney.

San Bruno police arrested Alviar after a person at the cemetery reported seeing him stand by the police at 12:49 p.m. and pull a Bible from a duffel bag. Alviar read aloud for several minutes — he later told police the chapter was Ezekiel 7 — before drinking water and pulling out a black handgun which he fired west and south.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Did he kill or harm someone? If not he should be let go. Anything less is an outrage.

Ummm... yeah, sure, you can keep and bear arms. But you cannot shoot in the direction of the highway. Your rights end where the rights of another begin.

What he did was dangerous, and as such, a reprimand is in order. Anarchism only works so well.

He can be reprimanded when he gets out of jail, or the psychiatric hospital. The guy's a nut. He's making up quasi-military rituals and shooting stolen firearms in a cemetery. The fact that the object of his mania is a noble institution does not lessen the fact that he's crazy and dangerous.

It is the S.F. Bay Area, so amber could be a little hasty to assume and a kidney infection would change that as well...

Exactly the point I was going for. For him to walk free, the police et al. would have to experience a serious lapse in judgement, one for which I would dismiss them from their posts.
