Duke Justice Demands Nifong's Removal (Susan Estrich on DukeLax

his is not the way the system is supposed to operate. Prosecutors are supposed to be out for justice, not blood; committed to the truth, at all costs, not winning, without more.

Prosecutors aren’t just morally obliged but legally required to turn over exculpatory evidence to the defense.

Prosecutors aren’t just one side in a battle.

You can’t come across the smoking gun covered with fingerprints on it – come across it because you have the power of the state to collect all the evidence – and then decide to ignore it because they don’t match the fingerprints of the guy you’re prosecuting for the crime. You certainly can’t file the report from the lab for your eyes only.

You have to tell the defendant that the smoking gun has someone else’s prints on it. He has a right to know that, and the prosecutor has a duty to tell him.

There is a reason that the rules are such. The prosecutor represents the people. The people’s goal is winning, which doesn’t have to mean a perfect conviction rate.

The goal is supposed to be to convict the guy who did it, not frame the guy you’ve got.

Somebody should tell that to Mike Nifong. Or to the judge who is in a position to do something about who prosecutes the Duke lacrosse players charged with rape.

What is going on in the prosecutors’ office in Durham North Carolina is disturbing in ways that go beyond the ugly allegations that started this case.

The District Attorney has clearly lost sight of his mission, and with it the last remnants of any ethical compass. The case has been characterized, since the outset, by a clear failure to follow the office’s own procedures and practices.

Does anyone else remember the link to the NCCU fraternity website that xoxoxo posted when this story first broke?

With the new information that Crystal had DNA from FIVE men in her (crusty?) underwear and body, it gets me thinking about the 'donors' of that DNA. A large part of me is wondering about those xoxoxo's posts. I would love to see if that DNA has been identified.

I hope something is done so that Nifong is open to civil litigation for his framing of these young men. I hope they are able to sue him for everything he owns and every single dime he generates until his miserable life ends in obscurity and disease, alone under some overpass.

Again, if I was the father of one of those boys I would make it my lifes work to ruin that man professionally, financially, emotionally, and spiritually.

He is already ruined spiritually. I believe the term 'wailing and gnashing of teeth' comes to mind.

Susan Estrich has also been public with her own rape. What I didn't read in this article was how LIEfong, if he was acting in good faith, would have tried to match the other DNA found inside of Crystal. The fact that he didn't do this, and that he actually tried to bury this evidence, clearly shows that he did not believe Mangum had been raped as early as April 11th. Yet he received his first indictments on April 17th.

Uh oh...

doubt it ask her what her position is on the liberal judge that gave Lynn Stewart 28 months and bail while her appeal is in progreass for aiding and abeting terrorist Abdel-Rahman...

She will most likely tell you it is a just sentence... Liberals just don't get the War on Terror period.

She may well support a sentence after there's been an investigation of all of Liefong's activities

Why defend Estrich. Here mild call for replacement is absurd. She should be advocating prosecution of this guy. She should be talking about Duke University, and the players themselves suing the pi$$ out of the jurisdiction he represents. She isn't a jury. But she certainly knows enough law to know that both a crime and have been committed here.

That's been discussed at length. The consensus seems to be that she was doing one-on-one "private parties" before dancing at the LAX party. Her 'driver' (Jarriel Johnson) has admitted as much.
