A private laboratory hired by the prosecution in the Duke lacrosse case failed to report that it found DNA from multiple males in the accuser's body and underwear, according to a defense motion filed today. The lab, DNA Security of Burlington, found that the DNA did not match the three defendants, their lacrosse teammates or anyone else who submitted their DNA to police, including the accuser's boyfriend.
The new evidence emerged in thousands of documents handed over to the defense in October.

A half hour ago, Court TV broke from the debutante trial for a newsbreak. Annika Pergament, the newscaster, only reported on the Duke case. She stated that the accuser "has given birth exactely nine months after she reported she had been raped by three Duke lacrosse players."
There was NO mention of the lack of DNA from the guys. Typical media. UGH!
Brian Meehan, the director of a private lab that tested DNA samples, testified Friday about the testing procedures and the report the lab delivered to Nifong's office, which defense attorneys maintain was incomplete.
The defense said the full report showed DNA samples from several men on the woman and her underwear, but none of the genetic material matched any of the players. Their motion also said that some of Meehan's own DNA contaminated the sample.
Meehan said the lab didn't try to withhold information. He said he and Nifong chose not to release the full report to protect the privacy of lacrosse players who weren't implicated in the case.

On April 8, 9 and 10, DNA Security found DNA from multiple males on the panties and rectal swab from the rape kit; none matched the lacrosse players.
On April 10, Meehan met in his office with Nifong and the two lead investigators in the case, Sgt. Mark Gottlieb and Investigator Benjamin Himan.
On April 18 and 19, DNA Security ran tests on pubic hair from rape kit; multiple male DNA was found that did not match the players or any other sample taken by police, the motion said.
On April 20 or 21, Meehan again met with Nifong and the two investigators in his Burlington office.

Nifong KNEW by April 20th (from a SECOND test, remember) that NONE of them were involved and yet he chose NOT to give that information to the Grand Jury.
If it cleared them, there is NO reason for anybody at ALL to be "implicated."
That would have never been Meehan's choice.
It didn't; it left a cloud over ALL their heads because remember we heard about a FOURTH player who wasn't indicted.
It's a lie and a CYA attempt.

Remember though, if it wasn't "written" in a report, then Nifong didn't have any exculpatory evidence to show the Grand Jury.

Certainly going over her entire sexual history would:
1. Be a great delaying tactic by Nifong.
2. Bore a jury to death.
3. Make it possibly impossble to complete the trial in finite time.
Yep, I wondered from day one if Daschel would try to get appointed as a caretaker holder of the seat. But I vaguely remember he is not long a SD resident as he moved to DC and maybe sold his SD house after he lost his Seat?
