A private laboratory hired by the prosecution in the Duke lacrosse case failed to report that it found DNA from multiple males in the accuser's body and underwear, according to a defense motion filed today. The lab, DNA Security of Burlington, found that the DNA did not match the three defendants, their lacrosse teammates or anyone else who submitted their DNA to police, including the accuser's boyfriend.
The new evidence emerged in thousands of documents handed over to the defense in October.

What does family know about accuser? Woman she is asked about it - says they do NOT KNOW where she is or who is supporting her. Woman says - the family asked her to be spokesperson. She said she didn't know where she was. Here is Ted:
Level of confusion among the family is so confusing - 5 family members thought she had had the baby last night.
Family says they complain they can't see her!!! Nifong is being blamed for this problem. Father has talked to TEd saying he has not seen his daughter. Father saw Nifong. Father said Nifong told father that HE would be in touch with the accuser and the accuser would make the decision whether or not she would see the family.
Accuser's mother - "I've not seen my baby in six months."
Greta: It seems like accuser is a prisoner.
Family members take the accuser's two children back and forth to school. Ted: It's a sad situation.
On Greta - so far: Not a word in this snippet about Meehan saying in court today that Nifong KNEW Meehan was not including the DNA facts that have been reported this week in the report turned over earlier to the Defense.
Ok - now: Shocking allegations that Nifong deliberately hid evidence.
None of the DNA from the numerous males found in or on accuser matched any of the Duke Lacrosse players. Found out that the reason this happened is that Niefong and Meehan met and decided that they would ONLY report what was a match and NOT REPORT the DNA that was there that did not match - or in other words - they would DENY the defense exculpatory evidence.
Is this a bombshell?
Woody Vann Defense attorney in Durham - fact that there were additional samples there says it remains to be seen if this is relevant at all....bears some weight ....but don't think it bears as much weight as some people think it does.

Great - fingernail found had one of the players possible DNA on it - defense theory is that DNA easily can be transferred. IN the hearing today, the scientist himself said that some of his own DNA was found on one of the specimens. Ted: that is a bombshell - re: the fingernail in the garbage can being contaminated by the Duke players. That is the ONLY source of POSSIBLE matching DNA in all the material gathered in this case.
Greta: The Identification procedure being tossed out - means accuser cannot ID the people in court - she ID's people who were not at the party / everything is wrong with this case, Greta......
Woman attorney - it is not only disturbing that Nifong agreed with the lab guy to NOT REPORT THE DNA reports - this is downright dishonest, outrageous conduct that should be subject of an investigation itself.
Greta: Is claiming Nifong did not ask Meehan not to report it - but NIfong DID say to Meehan only to report the DNA that matched. That is just as bad.
Attorney talking now: Says this is a conspiracy to obstruct justice.....this DA should be looked at being taken off the case. (HA - he should be looked at as committing judicial misconduct and be disbarred and jailed!!!)

Nifong is saying he has never interviewed the accuser.
DA is not going to toss it out.
Case really seems to be falling apart day by day.
(There was no case to begin with - which you would know if you noonies had been paying attention.)
Jim Hamer on the hiding of DNA results: Could be conspiracy to obstruct justice. Needs to be investigated. Nifong needs to be off the case.
I think his business is screwed. Of course he just sold it to some poor sucker. I think he decided to not tell lies on the stand. Losing your business is one thing. Losing your freedom is another.
For crying out loud Greta, drop the inane banter among your guests. It is not clever or funny. And get rid of that little creep Bernie Grimm.

I know this is frustrating, but the defense is doing a masterful job tightening the noose around Nifong's case and career. They are methodically cutting off avenues of escape. The foundation of the prosecutorial misconduct case has been established in open court. It will be cemented at the February hearing. Too many details to remember or rehash, but Nifong has nothing but the FA testimony, and if she testifies in February, he will not have her either. Defense counsel strategy here is not simply to get the case dismissed, but to leave no doubt as to their innocence, a much different strategic goal. Frankly, they are also laying the foundation for a civil lawsuit. In addition to Nifong and the DPD, the citation in the Motion for Change of Venue to the wrongful activity of Duke faculty is intriguing and a warning shot.
As far as Nifong's career goes, now they have testimony that Nifong concealed material evidence because he represented to the court that there was no relevant information in the raw DNA information. Misleading at best and reasonably viewed as an out and out lie. The February hearing will bring out how deeply involved Nifong was in the flawed line up procedures, and how he cut corners and dissembled to achieve a desired result on schedule.
This is the first time during this process that I will not be surprised if Nifong drops the case before trial. While he is in pretty deep doo-doo right now, that February hearing is more dangerous for him because it goes to the heart of the "investigation," the knowing violations of civil rights, and the intrigue and skullduggery of hte early days. So . . . either Nifong drops it before any more damage occurs in February, or he puts the FA and the stand to testify about the lineups, and she discredits herself during testimony. In either case, the charges are dropped. We saw today the DNA expert and Nifong pointing fingers over who said what to whom, and in February Nifong the FA will go through the same thing.
For the life of me, I can't figure out why he's keeping her away from her family.

She asked the Durham attorney about these grand jury notes.
The Durham Attorney says that in NC, NOTES ARE NEVER KEPT OF GRAND JURY PROCEEDINGS.
This statement totally stumped Greta and cause major chagrin and howls of laughter from all the attorneys on her program....with Ted saying this is totally scary - and with Greta saying - how can that be? when the Grand Jury process is to be used to supervise the legal process so to speak.
They all just laughed and laughed - I said NC was becoming a joke.
HERE IS SOMETHING FOR OUR USELESS NC LEGISLATURE TO FIX - Make it a requirement that NOTES be kept of Grand Jury proceedings - otherwise anybody can do anything in these proceedings.
The Durham Attorney finally said - most in legal field in NC don't put much stock in grand jury proceedings - and see them only as a way to move a case from a local court into a higher court.
Just listening on Greta. I don't understand no one knows where this girl is. Has Nifong stashed her somewhere??

But the fact that 5 family members thought she had already had the baby is a total blowout giveaway that she truly is being "hidden".
Unless the family is just at their wits end with the accuser...I just don't know either.
She may know too much.
