Teen Murderer Says Jail Is Too Hard, Appeals Sentence

DAYTONA BEACH, Fla. -- One of the teenagers responsible for beating a Holly Hill homeless man to death asked a judge to reduce his 22-year prison sentence Monday. Warren Messner and three other teens pled guilty to killing the man because they were bored, but Messner said prison is too hard.

Messner is a big boy. He was 15 at the time he was brought into the woods to see the homeless man his friends had been beating. Even at that young age, he outweighed the victim, Michael Roberts, by 200 pounds when he jumped on his chest, crushing his ribcage. Roberts died.

"Did you feel bad when you are doing it?" Messner was asked during questioning.

"Not really, no," he replied.

He didn't feel bad then, but he does now. He has been in juvenile detention for eight months, locked in a small cell and occasionally allowed to go to class.

Messner and his attorney said he has already learned his lesson and is ready to go home to help others. ...

"He's not getting the mental health, the schooling. He's not getting anything, anything but locked in a cell all day long," Lori Messner [his mother] said.

The judge and the state both argued that being deprived services and being locked away is precisely the point of prison. Warren Messner will spend the next 22 years in prison without the chance for parole.

The kid is what, 16 and a bit?

He had better be spending time in the weight room getting bulked up for when he gets to a real, hard core prision.

Um I kinda think that is the whole point. And if I remember rightly education is made available to inmates as is physical and psychological health services. But even if it is true that he is just languishing in his cell, poor baby. We know one other thing he is not getting and that is a chance to kill another person.

So mom if you think prison is too hard for your son be grateful at least you still have him around. Which can not be said for the victim's family. But I can tell by your words that the apple did not fall far from the tree. Whiny moms who always think the law, school, community are picking on their child do a good job of rearing criminals.

I would have liked to see the scumbag to be buried alive. I saw this Friday's Las Vegas and Ed Deline swears to Mr. Tips who buries his daughter alive for ransom, he'll make sure he gets his just dessert. I loved the ending when Mr. Tips wakes up buried alive in the coffin in the middle of nowhere. Some people are so truly evil, they don't deserve prison, period.

He'll probably be transferred to adult jail at 18. In some states, like CA, its 25.

Trust me, if he wasn't receiving those services, Alberto Gonzales, our US Atty Gen, would be at the front door of his facility wanting to know why he wasn't.

I disagree. If anything, as a weak, fat, greasy target, he'll be even more interesting to the other, tougher convicts.

Let's see if he gets more mercy than he gave.

Good thing he didn't sell any weed to an undercover cop while posessing a firearm, instead of committing cold blooded murder. He might be looking at another 55 years instead of only 22.

The article has a link to stories about the other wayward youth involved in this crime. In this one, the perp's stepfather explains that the lad is really a "good kid," though "he's had his problems." I suspect none of these kids grew up with two married biological parents in the home.

I think death would have been too harsh for a kid whose upbringing {judging by his mother's behaviour} was clearly deficient in significant ways - but for the sake of protecting society and exacting appropriate punishment to the crime, a life sentence would not be out of line!

As it is - young Mr. Messner will be out before he is 40 years of age, and have had ample time to consider the grievous errata of his youthful ways. I pray he makes the highest and best use of it...for the sake of all involved.

He's getting food to eat, a place to sleep, and 22 years to think about how he robed someone else of the rest of his life. I would say her son should be thankful for what he is getting.
