I'd have to read the ruling, but to suggest that the executive, empowered with specific charges from the legislative, is not able to perform those duties without calling the law itself unconstitutional is one of those things that typically the Ninth Circus is all about. This, if it goes further, will be nipped in the bud, and like any other inane ruling from a court, should be completely ignored.
The Administration's response should be: The judge is a moron.

We would have if the United States & the Soviet were not allies in fighting Nazi Germany. Remember before Hitler turned on Stalin their was a strong Antiwar movement in the US headed by the Communists. That all changed after the Nazis invaded the USSR. Biggest mistake Bush made after 9/11 was not reenacting the sedition laws on the books in both WWI & WWII. He should have realized that the American LEFT with their brothers in the MSM & democratic party at some point would undermine the war effort.

Yet another reason why I wish they were still around today.
As far as I'm concerned, the only people who are using unconstitutional powers are dem appointed judges, who seem to think that the Judicial system has suddenly changed and given them the power to play God. We better pray the dems don't ever get a total majority on the Supreme Court, otherwise we'll be seeing crap like this on a grander, and more dangerous, scale.

Too late, the "brilliant" voters decided to hand over judges to the liberal Dems in the Congress.
It's called "sending a message".

"she ruled the provisions remained too vague to be understood by a person of average intelligence and were therefore unconstitutional." Ruling that portions of the Patriot Act were too vague this same "whack job" established a right for a person of average person intelligence to understand the law.
So on this basis the Income Tax statutes are unconstitutional not to mention Campaign Finance and most of the other laws written recently (say since 1920?).
We want this one committed to a mental institution, not impeached!
