If he has been operating out of Syria as we knew he did earlier on, then he is safe. Otherwise, he just may get nabbed one of these fine days.
We should remember Saddam's public statement (after he was sitting in a jail cell), to the effect he wanted Izzat rubbed out due to his lack of leadership along the lines Saddam wanted him and some others to pursuit to keep the insurgency alive.
My bet is he still has a nice comfy office somewhere in Damascus and is protected by the Syrian Secret Police.
