Actually, wouldn't it be a good thing to have that kind of justice spread to the U.S.?
Imagine that birth control pill manufacturers and prescriptions writers (doctors) were also liable for contraceptive failures. Less doctors and clinics and hospitals would dare to write those prescriptions.
Laws like that could probably be expanded to the most notorious birth control method of all: abortions. If anything at all goes wrong during the abortion, the doctor/clinic could be hit hard with a lawsuit. Also, if a woman has a late term abortion performed and later has guilt feelings, she could sue the doctor/clinic for being complicit in committing a crime while she was very guilt laden and was very emotional and very mentally weak when she had the procedure performed. .
