Attorneys file motion to cap prison population

Inmate rights lawyers filed a legal motion Monday to cap the population in the California prison system.

The motion was filed in a pending class-action lawsuit in Sacramento, already settled on behalf of the plaintiffs, to improve mental health care in the prison system. A second motion was expected to be filed later in the day in San Francisco in the class-action case that regulates overall health care in the system.

A press release filed by the attorneys cited two 2004 reports as saying that the prison population should be reduced to anywhere from 111,300 to 138,000. The prison population currently stands at 173,000.

"Court intervention is necessary to achieve constitutional conditions because the state of California has been unable to respond in any meaningful way to the prison overcrowding crisis," one of the lawyers, Donald Specter of the Prison Law Office, said in a statement.

If they're serious about reducing the prison population, they could start by clearing out death row.

Maybe the state of California will sell "MURDER LICENSES"..in theory that would also keep the number of inmates down..after all, then it'd be illegal to kill someone without a license..

Maybe that's what they meant by "cap the prison population".

The legislature should pass a law that released criminals be given subsidies to live in the judges' neighbourhood. Oh, I'm sorry, this is a California legislature...

Better a prison overcrowding "crisis" than a murder/rape/arson rampage "crisis"

These guys are morons -- a "capped" prision population means only one thing: early release of prisoners and lower sentances. Which means only one thing: more crime. Of course the majority of crime will occur in the inner cities. I love how liberals love to help one population (in this case prisoners) run roughshod over another (in this case primarily inner city residents but pretty much everyone else eventually).

California accords more 'rights' to prisoners, seemingly, than it's own citizens.

This is the state that provides inmates with cable TV, law libraries, heart transplants, and conjugal visits (by either sex) among many other benefits.

And most don't serve their complete sentences....

Pretty dizzgusting!
