Lessee. They talked about the weather, they talked about her kids, they talked about her kids kids, they talked about his grandaddy's coon dog, they talked about the poles down at the strip joint she works at but he hasn't talked to her about the "rape"?
What is his case based on? Hastily scribbled notes taken while waiting for the next nascar race? I can't believe he's the DA.

There was an even worse case in Michigan, I think it was--a married woman got pregnant by her boyfriend who pressured her into accusing her husband of rape, which she did. There was zero evidence that any rape had occurred and the husband refused to admit guilt. The prosecutor was running for re-election and wanted to please the feminists. The man had no lawyer because he had resources which he couldn't touch because of a court order, but because he wasn't indigent he wasn't given a lawyer by the state. He received a long prison term which he is still serving. Phyllis Schlafly wrote a column about the case a few months ago...I remember reading about it on FR.
One of the worst travesties of justice I have heard about. With our legal system, that kind of thing can happen to anyone. At least the Duke lacrosse players haven't yet been sent to prison.

Nifong is the accuser's attorney, and the N.C. taxpayers are paying for her "defense".

Except that in court today Nifong confirmed that he took over as chief investigator on March 24.

Even if the DA is "representing" the accuser, the accuser probably has her own atty as well.

The result of this revelation means that this prosecutor has not done due diligence on the first step in a prosecution; verify the facts.
It would appear that his manner of response simply accepted, at face value, whatever the accuser said.
How can the people of the jurisdiction he works for get him out of office? As soon as they do, they need to look into the rest of the prosecutions he has handled.

I'm recalling from way back that both the accuser and Kim Roberts have lawyers. There is no role for them in the criminal trial of the lax players, but I bet they're going to need them in their own criminal trial later.

The accuser's former attorney...when she was arrested for stealing the taxi cab, speeding, and evading the police...has been on TV. Whether he is still her attorney or anyone else is has not been revealed...at least in any news source that I have seen.

The people of the State of North Carolina should be ashamed. This is a racial prosecution to gain political favor. African Americans charged with crimes that NEVER OCCURRED would still not be under indictment. This is a wake-up call for America and North Carolina.

The next election is November 7. And that's what this is all about.
Nifong is pandering to the local relatively poor Democrat majority black constituency in the county by falsely prosecuting three rich white Yankee Duke students. Despite the gaping holes in his case, the polls show him ahead. More on that later.
Nifong was appointed to the open DA spot by the Governor about 18 months ago. So he's never stood for election and had no name recognition. He jumped on this false claim just before the primary in May and used it to win over a challenger who was favored for having recently won a high-profile case. Since Durham is so heavily Democratic, the Republicans didn't bother with a primary and so don't have a candidate on the ballot.
The case started to fall apart AFTER Nifong won the Democratic primary. At that point he thought he was "in" as DA. However, there began to be a groundswell against Nifong, and another Democrat named Cheek collected enough signatures to get on the ballot as an "unaffiliated" (UNA) candidate. After getting on the ballot, Cheek "changed his mind" and said he would not serve if elected. It is thought he's going to get a payoff of some kind from Nifong for having squashed any other Democrat's chances to collect enough signatures. If Cheek wins, Nifong's out, and the Governor will appoint someone else as DA. Cheek is not campaigning, but has people campaigning for him under the slogan "Recall Nifong - Vote Cheek".
Meanwhile, a Republican named Monks gathered enough signatures to qualify as a write in candidate on the ballot but not enough to actually have his name appear on the ballot as UNA alongside Cheek UNA and Nifong DEM.
Instead of attacking Nifong, Monks has spent all his time attacking Cheek claiming that he, Monks, is the true alternative to Nifong because he, Monks, WANTS to serve as DA, unlike Cheek who does not. By doing so, Monks is probably helping Nifong since most Democrats in the county will never vote for a Republican.
It's pretty messed up.

You're right about Woody Van. But I'm not talking about him. I thought she was also mixed up with a civil trial lawyer. I could be wrong. Of course, he's the wrong kind to defend her against criminal charges.

Well, you seem to be telling me that there might be something positive coming from this DA - after November 7th.
Maybe he will drop the case after the election; after he has gotten all he can get out of it - his election victory.
At least that will be positive for the defendents.
If he does that, the defendents should start a public speaking and fundraising tour for a suit against the DA for wrongful prosecution. It does not matter that he did not take it all the way to court.
They should be able to show (from the real evidence) that he (1)has for some time not had enough evidence to prosecute the case and (2)that he delayed that admission for his own political gain and (3)his false attempt to prosecute them amounted to slander by a public official.
