ALBANY, Oct. 26 Attorney General Eliot Spitzer, the Democratic nominee for governor, withdrew his support from the embattled state comptroller, Alan G. Hevesi, on Thursday, and made it clear that he expected the State Senate to consider removing the comptroller from office for using a state employee to chauffeur his wife.
Gov. George E. Pataki, meanwhile, was returning early from a trip to Hungary to deal with the Hevesi situation. His aides said he would decide by Friday whether to call on the Senate to consider removing Mr. Hevesi; in the meantime, they considered selecting several well-known former prosecutors and judges to present the case against Mr. Hevesi.
A separate criminal investigation of Mr. Hevesi was proceeding on another front. The Albany County district attorneys office issued subpoenas to state police officials ordering them to appear before a grand jury that is weighing whether to charge Mr. Hevesi with any crimes, according to an official told of the subpoenas, and who requested anonymity because he was not authorized to speak about the investigation.
Mr. Hevesi is seeking re-election, and the swirl of events comes less than two weeks before Election Day. The withdrawal of the endorsement from Mr. Spitzer, one of the states most powerful and popular Democrats, dealt a heavy blow to Mr. Hevesi, a fellow Democrat.
Mr. Spitzer said a report by the State Ethics Commission that accused Mr. Hevesi of breaking the law presents information that compromises Alan Hevesis ability to fulfill his responsibilities.
Mr. Hevesi responded in a statement: I have a great deal of respect for Attorney General Eliot Spitzer, and believe that he will make an excellent governor and implement essential reforms. I also believe that five million voters should select the next state comptroller on Nov. 7.

it's been on the radio news a lot here; Hevesi could be in trouble and is feeling pressure to resign...
I'm sure it is too late to change the ballot. So, if he gets replaced in office before the election is a vote for Hevesi actually a vote for his "selected not elected" replacement?

I watched the debate last night. Really pathetic to see Hevesi.
The tragic thing is he will probably still win if he doesn't drop out. Then he will be removed and Spitzer will appoint someone else.
NY is not far away fom being Louisiana North.

Technically, Sheldon Silver has more power over appointing a replacement for Hevesi than Spitzer. According to one of the papers today, I think, the State Legislature sits as a whole to name a replacement. Since there are more Dem Assemblymen than Republican Senators, Shelly Silver will hold the power.
Half jokingly, Silver will probably name someone connected to the Dolans. He seems to be in Cablevision's pocket - or they know something we don't know about him.
