CA: No rush to grab a hot potato - Prop 90 Eminent Domain initiative

Gov. Arnold Schwarzenegger visited an urban charter school Tuesday to emphasize his support for public works bonds on the November ballot, but he said he has to give more thought to an initiative restricting government control over private property.

Running for the state's highest office, Schwarzenegger and Democratic challenger Phil Angelides face pressure to take positions on all 13 ballot proposals to show where they stand philosophically. But each has deferred one ballot choice for seemingly political reasons, even with Election Day only two weeks away.

While Schwarzenegger toured the American Indian Public Charter School in Oakland to tout the bonds, including a $10.4 billion school construction measure, Angelides made Northern California stops to convince his base that a national "Democratic tidal wave" will sweep him into office.

The property initiative poses a political dilemma for Schwarzenegger because it is backed by his GOP base yet opposed by environmental groups and the California Chamber of Commerce, two interests the Republican governor has courted.

Schwarzenegger said Tuesday he has not taken a position on Proposition 90, though he intends to "very soon because I'm looking at all the aspects. As you know, it's a very complicated issue, and so I'm looking at all the different angles so that I come out very clear."

Proponents have asserted that Proposition 90 prevents government from seizing private property to give to another private owner. Opponents say it goes too far by requiring compensation whenever any new law substantially reduces the value of one's property, a possible hindrance to land-use powers.

Angelides, who opposes Proposition 90, charged Tuesday at a labor event in Hayward that Schwarzenegger's uncertainty means "the guy's got a character flaw."

This statement seems absolutely insane. How can anyone with any sense of fairness oppose property owners being compensated when the government deliberately reduces the value of their property?

This shows how bizarre and insane the leftist's view of reality is. Remember, in their view "property is theft".

I am currently battling a township here in Michigan over the house in my deceased mother's estate. She was in nursing home for 7 years, and the garage on her very old home is collapsing. The township condemned the home and ordered demolition. As personal rep for her estate I am trying to sell the house. I have attended 2 hearings, and now the buyer I found has to go before zoning appeals board. I believe that the restrictions eliminate the value of my mother's estate and therefore is subject to inverse condemnation (where government seizes property without using eminent domain). Problem is money. If I file inverse condemnation suit, it would probably cost more than the value of the property.

It ain't complicated Arnie. The only "angle" that is complicated is whether you are going to do the right thing or side with the big-government cronies. Just say "YES" on 90! (Endorse Mountjoy for US Senate while you're at it, will ya?)

I'm for property rights and against socialism. Whoever doesn't take this stand isn't a conservative but a socialist. Vote YES on Proposition 90!

What about air emissions regulations, for example? Say you own a factory and there is a certain regulation that governs the emissions from your exhaust stack. Now assume that your state's environmental agency promulgates a new regulation that reduces the allowable emissions. Your factory is now worth less, since you must spend money to meet the new regulations. Do you deserve compensation?

It could be. To put it more simply, if the state makes a law that your property, such as say a gun, is now contraband, it should compensate you for it. If the State changes regulations, because of new evidence, to promulgate public health, then the public should pay for the damages created to promote that health.

In most such cases, if the evidence is clear, then victims can sue for damages as well.

If the property owner acted in good faith, they should not be damaged for the public good, without compensation.

The EPA has disregarded hundreds of years of precedent in the way that it unilaterally bankrupts people for merely owning property, even if there is no link to damages.

And G.W. Bush's great sin is the creation of the Homeland Security agency.

Both huge,powerful,un-needed expansions of federal power and encroachments on American freedom,when agenvcies already existed to deal with the instant problems.If the relevant agencies were ineffective they should have been disbanded or reformed,not aggrandized.

So, you should have an ballot to send, or eventually fill out. Since Arnie is so bad with you, and you'd recall him if you could, (such desperation when there is an election), I assume you will be voting for Philthy. After all, he does have the best chance of beating your nemesis.
