Judge: Count all votes cast for Brown

A judge on Tuesday ruled that votes for Jerry Brown for attorney general should be counted, delivering a blow to a long-shot bid by Republican officials to have the Democratic Oakland mayor declared ineligible for the office.

Brown, the front-runner in the race against state Sen. Chuck Poochigian, R-Fresno, hailed the decision as proof that the Republican lawsuit was a political stunt.

It's an "incompetent effort to sabotage the democratic process and the judge summarily threw it out by saying come in after the election," he said in a phone interview.

But the five Republican officials suing promised to press forward.

"We see a wrong happening -- you have to do something about it," said Mark Pruner, chairman of the Yolo County Republican Party.

The suit asked that Brown's votes not be counted because he does not meet the qualification that an attorney general be "admitted to practice" before the Supreme Court of the state for a period of at least five years prior to the election.

Brown, a former secretary of state and two-term governor, was admitted to the California State Bar in 1965. But he went on "inactive" status in January 1997 and did not reactivate until May 1, 2003, meaning he has been on active status for only 3 1/2 years.

Poochigian supports the lawsuit but is not named as a plaintiff.

"It's still quite clear that they might rule that he is not legally qualified," said Ken Khachigian, Poochigian's campaign strategist.

Sacramento County Superior Court Judge Shelleyanne W.L. Chang did not rule on the merits of the case. Rather, she told attorneys in a private meeting that the suit should follow the normal procedures that it not be heard until 16 days after the defendant is served with the suit.

Jerry Brown is the "worst" possible excuse for an elected politician there could possibly be. In talking to people that work for the State of CA, the guy is a total Liberal jerk. Proof positive that there's a severe shortage of brain cells working in the State of California.

To clarify my previous post, Jerry Brown running for Attorney General is an insult to everyone's intelligence. He's a Liberal's Liberal and will be the "worst" candidate ever for the position. Just his name associated with the position of Attorney General is a sick joke.

I disagree, Grey Davis was State AG and gave one of the most hate filled anti gun speechs I have ever seen to a combined session of the State Assembly and Senate. Pure lies and vitriol

16 days. Well, shucks! The guy has been ducking the process for over a week now. Again yesterday, in open Court, Brown's representatives refused to accept service. I cannot think of a worse AG.
