Nothing to do with 9/11?

OBL read and copied the Fatwa that Stewart smuggled out of the jail.

OBL finished the job that Stewart's client started.

How is it possible that this had nothing to do with 9/11? That just doesn't make any sense.

Title 18, section 3742(b) of the United States Code provides:

(b) Appeal by the Government.— The Government may file a notice of appeal in the district court for review of an otherwise final sentence if the sentence—

(1) was imposed in violation of law;

(2) was imposed as a result of an incorrect application of the sentencing guidelines;

(3) is less than the sentence specified in the applicable guideline range to the extent that the sentence includes a lesser fine or term of imprisonment, probation, or supervised release than the minimum established in the guideline range, or includes a less limiting condition of probation or supervised release under section 3563 (b)(6) or (b)(11) [1] than the minimum established in the guideline range; or

(4) was imposed for an offense for which there is no sentencing guideline and is plainly unreasonable.

If, as stated by some of the other posters here, there is no specific minimum sentence in this case, the government could try to appeal this horrible miscarriage of justice under subsection (4) as being "plainly unreasonable."

So we get a twofur.

I'll bet she gets rich from the clients sher lines up from the inside. I wonder if her lawyer will insist on getting a cut?

These kinds of sentiments only encouraged leftist law students at the City University of New York to attempt to present her with the school’s Public Interest Lawyer of the Year award at graduation ceremonies last month. A group of students gave administrators a petition containing 73 names—more than half of the graduating class—in an effort to reward Stewart for her betrayal of her country and its citizens. This turned out to be an award too far, however. After the award was leaked to the press, CUNY law school dean Kristin Booth Glen informed students via e-mail that Stewart would not be honored because that “could lead to consequences that could be damaging.”
This brought out the martyrs brigade again.  Kathryn Hudson, the CUNY law student who spearheaded the effort to fete Stewart, fumed, “If you can’t have free speech at a law school, where can you have it?” Said graduate student, Kavita Pawria, “There is an irrational fear being used to suppress civil liberties.”
Stewart herself got into the act, saying, “The students seem to carry on a long tradition of reminding institutions of their responsibilities. They are willing to take the risk, but Dean Glen apparently is not.”
Stewart ended up feeling quite feted, however, as CUNY’s Criminal Law Society honored her at a private ceremony prior to graduation. Considering CUNY law students’ abysmal 50 percent passage rate on the bar exam, engineering this small victory was quite resourceful.

Treason? I've have her executed for it. We don't take the War On Terror seriously when a traitor is given such a ridiculously light sentence. I remember the feds put Jonathan Pollard in prison for life for passing on secrets to Israel. I've always thought it was too harsh. Here we have an anti-American radical who helped Al Qaeda terrorists kill Americans and she gets a couple of months in prison? This is American justice?? Excuse me while I gag!

There is more to the story...

Stewart, 67, who was diagnosed with breast cancer last year, smiled, cried and hugged supporters after U.S. District Judge John G. Koeltl announced he was dramatically reducing the 30-year prison sentence called for by federal sentencing guidelines.
The judge said Stewart could remain free pending appeal, a process that could take more than a year.

Civil rights lawyer Lynne Stewart was sentenced to 28 months in prison in federal court in Manhattan Monday. She was convicted of providing support to terrorists by helping a jailed Egyptian sheik communicate with his followers on the outside.

Good Gawd, sometimes the WOT appears synonymous with trying to paint a battleship.

Lovely! Does this sentence justify the costs of pursuing this case? People get more for growing marihuana plants for their own use in their basement. Can a sentence be appealed by the prosecutor, and will this one be appealed?
