Wild Bill at Passionate America that discovered the name of the former page that received the sexual IMs from Foley has received an email from Jordan Edmunds attorney, Stephen Jones, demanding he pull the story. Wild Bill is looking for advice from any leagal eagles out there.

I receive junk email all the time that I never even open. I just delete it. ;)
"Without any foundation or legal permission, you are stating that our client is the person associated with the Ims.
you cease any further efforts to identify our client with these alleged Ims and cease publishing such information on Passionate America."

LOL. Ya think they're going to say this Jordan isn't the author of the IM's as a defense?
Someone needs to get a screen shot of all the stuff and put it here. I wonder who'll they'll go after here at Freerepublic to take down the information? I bet JR will tell him to pound sound.

Agree with your advice about the value of internet legal advice, but I do have one suggestion: he should ask Jones to provide the legal basis for his demand that he pull truthful information from a web site that is devoted to posting news and information. Make Jones explain his theory for the demand.
There is absolutely no way that this e-mail was written by an attorney, running off on a weird, subjective muddle about "mistakes" and "errors" by ABC as it does.
I don't know that a cease-and-desist letter has any real legal significance anyway, except that if the lawyer goes ahead with a lawsuit or asks for an injunction, it looks better if he can say he tried this first. The law on it might vary from state to state, though.
(I know that in MA, to sue under the Consumer Protection Act, your supposed to send a demand letter citing the statute -- and wait I forget how long for a response -- before filing suit, but I know of a couple of cases where the demand letter was never sent and the trial went on.)
Right, blackmail is certainly an option. Which sort of fits under the "prank" header although it was for gain rather than giggles.
In order to believe this email exists I am going to have to see two copies of it ..... similar but not identical of course.

I did call my constitutional lawyer friend who relayed the following:
1) Edmunds's complaint against Kerr would be an issue of privacy, not one of constitutional rights.
2) He would not touch Kerr, who has now globally "outed" a lawyer and a former page, with a ten foot pole.
... which is why I immediately thought the lawyer was behind the "prank" claim, whether he's owning up to it or not ... claiming that this was a prank takes care of several potential problems for his client, such as intent to extort, as well as removing any question about his sexuality.

That's easy to spoof. What I'd need to see is the full header.
What email program are you viewing the email in? Can you check under the Edit or View menu and see if there's an option to view full or long headers? That will tell us where it was really sent from.
