No, age of consent in DC is 16, there is no question of statutory rape involved. The only question is whether hinting via the internet that one wants sex to a 17 year old while arranging to meet after the 'hintee' turns 18 violates the Federal anti-internet-solicitation-of-minors statute. Alas, that question really does seem to turn on Clintonian word-parsing.

One thing is Jordan is very likely to hit the financial jackpot on this. ABC wrongfully released his name, if only for a few minutes. It was long enough for his identity to be revealed to the entire world and ABC's lawyers no doubt are talking about a settlement offer at this very moment.

It is, but a Federal law (sponsored as a bill in the House by Foley) makes it a Federal crime to use the internet to solicit sex from a minor, irrespective of local age of consent laws.
Isn't that a new law? Would it be in effect retroactively to the time these emails were made?

Everyone should think about this. If that guy did NOT save and give those IMs to ABC, than he literally can OWN ABC now. They negligently allowed his IMs to be posted without making sure his screename was removed and someone traced it to him. So, if he's innocent of giving up the IMs, then he's about to be a very, very rich young man.
