I really don't have much appetite for Foley going to a cell to do hard time really. His problem, is that his closetedness caused rather severe arrested emotional development. Just me theory of the moment. Just my off the hip thought.

I can't say that I have much sympathy for the disgraced former Congressman. If he did anything that was a crime, he should do the time, just like anyone else would. I really don't care what his closetedness caused. Psychological explanations don't impress me much.

Well, based on what has been revealed thus far, and presuming nothing further for the sake of argument, then I would agree with you. Foley's career and reputation have properly come crashing down into oblivion, so unless there's more than the contemptible IMs that have been linked I'd also say that's punishment enough.

However, if a law has been violated, and particularly if it's a law sponsored or endorsed by Foley, then he should be prosecuted to the full extent.
