Georgia Voter ID Bill Struck Down; Big Win For Dems(Plot revealed)

This is big. In a victory for Dems, a state judge has just struck down Georgia's pernicious new voter ID law, which would likely have discouraged many poor and elderly people (that is, Dem-leaning voters) from casting ballots. This one decision could possibly help decide control of the House. Georgia is one of a very few electoral fronts where Dems are struggling; thanks to redrawn districts, Dem Reps John Barrow and Jim Marshall are both facing tough challenges. Some pundits have said Georgia could cost the Dems control of the House -- but now, thanks to the decision, they're both more likely to hang on to their seats. In an interesting decision, Fulton County Superior Court Judge T. Jackson Bedford, Jr., wrote that the ID requirement is in essence a new qualification to be a voter -- something which cannot be done by statute. He wrote that it also fails in light of people not needing an ID to register in the first place:

"The 2006 law requiring a photo ID as the exclusive means of proving one's identity at the polls and thereby making the possession of an approved form of photo ID a prerequisite to voting in person and having one's ballot counted violates the plain terms of the Georgia Constitution."

The state is expected to appeal it to the state Supreme Court, but a ruling in their favor doesn't look very likely -- every judge who has reviewed recent Voter-ID laws in Georgia has ruled them unconstitutional.

All in all, it's good news for Dems -- and for Georgia voters.

Since one does not have to prove he is a citizen, or produce ID to vote, it is time to play with the Dims. Any voter is obligated to vote as many times as necessary. Since we are not limited by law, why limit ourselves when the opposition does not, and plans it that way?

OK, let me get this straight. We can require people to register to vote but cannot require them to prove they are who they claim they are?

The US House bill requires states to provide free ids to those who cannot afford them. I suppose next the Democrats will argue that registering is too difficult for the poor and we should do away with that as well!

You need an id to write a check, buy booze, buy cigarettes, rent a car, withdraw money from the bank...but no proof that you are who you say you are for voting????????

Here is what the State of Georgia Consiutiion says about voting. Don't see anything here at all that conflicts with this law.

SECTION I.

METHOD OF VOTING; RIGHT TO REGISTER AND VOTE

Paragraph I. Method of voting. Elections by the people shall be by secret ballot and shall be conducted in accordance with procedures provided by law.

Paragraph II. Right to register and vote. Every person who is a citizen of the United States and a resident of Georgia as defined by law, who is at least 18 years of age and not disenfranchised by this article, and who meets minimum residency requirements as provided by law shall be entitled to vote at any election by the people. The General Assembly shall provide by law for the registration of electors.

Paragraph III. Exceptions to right to register and vote. (a) No person who has been convicted of a felony involving moral turpitude may register, remain registered, or vote except upon completion of the sentence.

(b) No person who has been judicially determined to be mentally incompetent may register, remain registered, or vote unless the disability has been removed

That can be fixed. And should be. I'm amazed that when you go to register to vote, you have to prove age and residence but not citizenship.

This means democrats can't vote anyway. Just take the democrats name off the ballot so only the constitutional votes will be counted. Problem solved.

None of those are rights guaranteed by the Constitution; they are all privileges. Not that I'm against verifying that all voters are citizens, but you have to pick the right approach.

The point however is to prove you are who you say you are, not that it's a right or a privilidge. Voting is indeed a right ...for those who qualify.

NOT having a valid ID these days destroys our ability to have a fair democratic election. Because our country is a representative republic, our democratic system has to be valid. Otherwise, it's Socialism.

Versus:

Sadly, another view of this is that we seem to safeguard our gimmies more than our rights.

In fact, requiring ID for drugs, contracts, and banking is more a matter of public order and commerce than of rights and priveleges. Requiring proper ID for voting should be seen in the same light - order and stability.
