Senate panel defies Bush on terror

WASHINGTON - A rebellious Senate committee defied President Bush on Thursday and approved terror-detainee legislation he has vowed to block, deepening Republican conflict over a key issue in the middle of congressional campaigns.

Sen. John Warner (news, bio, voting record), R-Va., chairman of the Armed Services Committee, pushed the measure through his panel by a 15-9 vote, with Warner and two other GOP lawmakers joining Democrats. The tally set the stage for a showdown on the Senate floor as early as next week.

McCain doesn't believe in torture at all, but he knows better than all others, that torture is employed and that his legislation will not keep one American from being tortured. It is wishful, stupid and IMO, dangerous thinking.

He says he was a JAG Officer during Gulf War I. Well so was my cousin and he evaluated contracts. I have yet seen anything in Goober's background to indicate that he has any specific experience in interpreting the Military Code of Conduct.

Listening to McCain and watching his antics IS torture.

If this guy thinks he's getting the Republican nomination in 2008, he's crazy.

On the other hand, he may be anticipating he's not, and planning an independent run in 2008.

His ego and ambition are big enough to motivate him to do it.

I am confused, what are McCain's arguments?

The arguement, generally speaking, is that if we create a two-tiered system, with one tier that circumvents the Geneva convention, other nations and powers would do the same. (They already do, of course, but they'd have our precedent to call it legal).

That means that if we had some guys operating out of uniform, and they got caught, it would be considered appropriate to torture them, since our own rules would allow it. (That's a largely symbolic distinction, since our enemies have never historically shied from torturing our POWs.)

Isn't that a slap at soldiers who do wear the uniform? Why would anyone sacrifice and volunteer to serve if they are disrespected by putting terrorists in civilian clothes on the same level of honor?????????

Here's how this problem began:

The Geneva conventions do not protect any armed force that operates without uniforms. The "uniform" can be as simple as a bandana or a shirt of a standard color, nothing fancy. It just has to be known and used. The rule was made to protect civilians, who would, of course, but unmarked.

It's not lawful to fight without a uniform marking, and it's completely lawful to execute someone on the spot for doing so. We simply choose not to. That means there's no disadvantage, and many advantages, for al-Qa'ida to dress as civilians.

We disregard a law meant to protect civilians by not executing the al-Qa'ida we catch. We have no one to blame but ourselves for that, and for the other legal troubles that stem from it.

They believe that they are much, much smarter than we are. Genius Graham says this is not the last war we are going to fight and he doesn't want to endanger our troops who are captured in the next one. Now just how smart does that sound to you?

And when this is passed into law, all our enemies throughout the world will instantly stop targeting our civilians, will stop hiding behind their own civilians, will not abuse or torture or summariy execute our captured troops, will not exploit captives for propaganda purposes, and will not desecrate the remains of our dead...

... And any enemy captured will instantly reveal mass-murder plots in progress when they see what nice, friendly, enlightended people we are...
