What's more, Mr. Ashcroft noted, the wall did not mysteriously arise: "Someone built this wall." That someone was largely the Democrats, who enshrined Vietnam-era paranoia about alleged FBI domestic spying abuses by enacting the 1978 Foreign Intelligence Surveillance Act (FISA).
Mr. Ashcroft pointed out that the wall was raised even higher in the mid-1990s, in the midst of what was then one of the most important antiterror investigations in American history--into the 1993 World Trade Center bombing. On Tuesday the Attorney General declassified and read from a March 4, 1995, memo in which Jamie Gorelick--then Deputy Attorney General and now 9/11 Commissioner--instructed then-FBI Director Louis Freeh and United States Attorney Mary Jo White that for the sake of "appearances" they would be required to adhere to an interpretation of the wall far stricter than the law required.
Ms. White was then the lead prosecutor in cases related to the Trade Center bombing. Ms. Gorelick explicitly references United States v. Yousef and United States v. Rahman--cases that might have greatly expanded our pre-9/11 understanding of al Qaeda had investigators been given a freer hand. The memo is a clear indication that there was pressure then for more intelligence sharing. Ms. Gorelick's response is an unequivocal "no": "We believe that it is prudent to establish a set of instructions that will more clearly separate the counterintelligence investigation from the more limited, but continued, criminal investigations. These procedures, which go beyond what is legally required, will prevent any risk of creating an unwarranted appearance that FISA is being used to avoid procedural safeguards which would apply in a criminal investigation" (emphases added).
In case anyone was in doubt, Janet Reno herself affirmed the policy several months later in a July 19, 1995, memo that we have unearthed. In it, the then-Attorney General instructs

so true...this be-itch should have been wearing an orange jumpsuit and begging the public not to stone her to death...what a crock that she would be allowed to sit her fat ass on that commission and pontificate about how it was Bush and the republican administration that cause 9/11...she is the root cause and must be held accountable!!!!
YIKES!! It's IS Bush's fault.../sarc
Gorelick collected $20 million in pay and "bonuses" while working for Fannie Mae over a four year period while the Clintons were in the WH. Nice work, if you can get it, eh ?
Bump. Good time to find this editorial. Why does Jamie Gorelick get such a stupendous pass?
If a president wanted to undermine the safety and security of our country, he wouldn't have to actually do it, himself. All he would have to do is put in place those he knows will do it.
Don't forget to mention that the millions she collected were the product of blatant fraud, which the Bush Administration won't prosecute.
I still don't understand why her scalp isn't on W's lodgepole.
When is this woman going to be called to account?
At least someone should write a comprehensive, hard-hitting expose on her entire career. She was no peach while General Counsel of the DOD, she was involved in representing guys in the BNA scandal. I'm sure there's more.
Bill Clinton = Emperor Nero.
Eric,
But wan't it Harold Raines (Spelled Correct?) that she was legal cousel too, resigned over Fannie Mae's Troubles?
Some help refresh my memory on this...
Might not be a bestseller (although conservative circles are enough to propel a book these days), but it would serve posterity well.
It also would serve to let people know they can no longer hide in the woodwork. The new media will find them out.
I believe you're correct. Raines collected more pay and bigger bonuses. They fluffed up their volume of loans to jack their bonus pool. In the civilian world, this is called self-dealing.
The $20 million she got paid from Fannie Mae should make good fire kindling!
The 9/11 Comission Report is FATALLY compromised. Gorelick's presence, along with the horde of Gorelick-friendly staffers, renders the report useless.
Gorelick was put on the commission panel for 1 reason, to cover the tracks of the dereliction of the Clinton Administration.
Because Slade Gorton and the other Republican RINO's on the panel have the spine of poached oysters.
I say put the author of "the Wall" in front of a wall.
