The link above is to a story by the LA Times, which does not allow us to post their stuff. In the article, it claims that two of the accused Marines of the Pendleton 8, Sgt. Lawrence G. Hutchins III and Cpl. Trent D. Thomas, admitted to killing the Iraqi man in question as an act of murder, not combat.
The LA Times or the Marine Corps representative who was quoted, Capt. Nicholas L. Gannon, has deliberately misquoted the statements of these men.
The Comments below are those of Cpl Marshall Magincalda's mother, one of the Pendleton 8, with an appeal to ALL: Write the LA Times and inform them of this apparent deliberate misquote and how it taints a potential jury pool, and slanders our troops in time of war.

If charges are filed the matter will go to a General Courts Martial. The jury will be selected by the conveneing authority from the available, qualified officers and enlisted under their command. There is no jury pool to taint.

I never knew a military court proceeding had a "jury pool" - aren't the people who sit in judgment all military officers ..??
If a court martial is deemed in order in this case the jury will be made up of a mix of officers and enlsited.

Okay .. that's what I thought .. but "tainting a jury pool" would indicate she thought it was the public in general, not military people .. Right ..??
Both of you knew it was a Jury of sorts, though, whether civilian or military appointed, there will be a sitting council of several Military officers and men who will pronounce judgement upon these Marines.
These people as of yet have received NO information with the exceptin of what they HEAR from the media.
That is tainting the people who are doing the judging.

I have a study in contrasts for you. Look at the two men in this contrast, and perhaps youll understand why I reserve a special, abiding distaste, dislike, and disrespect for ex-Marine John Murtha. (Yes, I said ex-Marine.)
First, Murtha. After making comments a few months ago about the Haditha Marines being cold-blooded killers, he has gone on to demand troop withdrawals, hang out with Code Pink (who, you may remember, gave $800,000 to the enemy), and generally make a complete horses of himself. Heres the latest quote:
Murtha said young men and women are not joining the military because of war mismanagement and all the killing and maiming in Iraq.
I guess the reader is left to decide who is the hunter and who is the prey. Either way, these are words that cannot be taken back. They are out of line, disgusting, and highly inflammatory against the Marines who are still innocent until proven guilty. At least last time I checked. Murthas idiocy, malice, and aid to the enemy is as neverending as his oral diarrhea and lack of respect for the uniform he once wore. Hes disowned his family for a political ticket, and thrown his brothers to the wolves for personal gain. He is corrupt, immoral, and a disgrace to the title of United States Marine.
Then we have PFC John Jodka III. Accused by Iraqis of murder, he and seven of his brothers are charged with a laundry list of infractions that carry the death penalty as a potential sentence. They have been in a 9×9 cell for almost three months while the government denied their attorneys access to evidence, denied their defense teams access to the alleged crime scene in Iraq, even denied them access to witnesses who claim the Marines and Navy Corpsman killed a man in cold blood. Jodkas Article 32 begins Wednesday; two of the other Innocent 8, CPL Marshall Magincalda and CPL Trent Thomas, begins Monday.
Here is what separates Jodka, Magincalda, Thomas, and the other five men from people like Jack Murtha: the simple knowledgeand never simple applicationof the words Semper fidelis.
The Marine Corps asked the defense attorneys if perhaps any of the men would be willing to take a deal. You can hear it now, cant you? The age-old game of Save Yourself. Care to give us a name? We could go easier on you, maybe even save your career.
Attorneys that I know have told me that sometimes they have on occasion counseled an innocent man to take a plea. Sometimes, they say, its just easier, cheaper, less hassle. The media, people like Murtha, liberals in general, theyre all convinced that the men are guilty. Why stand? Why keep claiming innocence? Why not just give up and take the easy way out?
What was Jodkas answer when faced with these questions? What was the answer of every one of them when asked if they would just testify against the others to save themselves?
Absolutely no. When hell freezes over.
As for morale, youd think after nearly three months of 9×9 cells and being railroaded, that these men would be depressed and ready to crack under the pressure. Then again, I guess if you did think that, you wouldnt know much about Marines. What is the attitude of these men and their lawyers going into a battle for their lives?
Lets get it on.
Thats why people like Murtha should never be in a position of power, and thats why people like you and I are still free.
