Doesn't matter for if they don't they are under the umbrella of the radar of a close by ATC. I heard a report that ATC didn't have visual contact with the aircraft. Is is possible that the position/anti-collision lights were not illuminated?

It's electronic surveillance via transponder which ATC receives aircraft identification, position, altitude, and flight parameter's in real time.
