DETROIT Aug 17, 2006 (AP) A federal judge ruled Thursday that the government's warrantless wiretapping program is unconstitutional and ordered an immediate halt to it.
U.S. District Judge Anna Diggs Taylor in Detroit became the first judge to strike down the National Security Agency's program, which she says violates the rights to free speech and privacy as well as the separation of powers enshrined in the Constitution.
"Plaintiffs have prevailed, and the public interest is clear, in this matter. It is the upholding of our Constitution," Taylor wrote in her 43-page opinion.
The American Civil Liberties Union filed the lawsuit on behalf of journalists, scholars and lawyers who say the program has made it difficult for them to do their jobs. They believe many of their overseas contacts are likely targets of the program, which involves secretly listening to conversations between people in the U.S. and people in other countries.

The judge agrees with the ACLU in wanting us all dead.
Wonder how much shopping the ACLU did to find this one?
Does this mean the government system that tracks my every financial transaction, and compels me to testify to such details, is also unconstitutional? Bye bye IRS?
They just scanned their membership list.
Since the judge's district is Detroit, don't do any wiretapping from Detroit. Do it from Fort Meade, where it's supposed to be done.
Or ignore the judge.
Seriously: start spending some serious resources out counterintelligence to find the traitors who are leaking this classified information, give them a fair trial, and have them shot (after conviction).
But even if Taylor harpoons the spying program, experts said, the decision likely would be overturned by the U.S. 6th Circuit Court of Appeals. "Given the composition of the 6th Circuit and its previous rulings in related areas, it seems more likely to favor national security over civil liberties if that issue is squarely presented," said Carl Tobias, a law professor at the University of Richmond in Virginia. "And that's what this case is all about."
Says a lot about the DBM, doesn't it? Mustn't let the sheeple get the wrong idea.
Are you sure that isn't Hillary in glasses and a dark wig?
any additional info on when appointed, etc???
A Jimmuh Carter appointee, 1979.
As Rush just covered, this is also the judge who attempted to hijack the UM Law School affirmative action case and join it in class action to the undergraduate case. Fortunately, the actual judge in the case was able to checkmate her on this.
Yes.
Impeach the judge. No court on the planet has the authority to stop us from intercepting international email/phone calls.
But Bush/Congressional Repubs lacks the balls to do that.
Call together the ACLU membership and shoot them for treason.
Wait, we can't do that, heck, taxpayers PAY them to use the courts to destroy the country!!
Of course, the GOP could use this to make every anti-war Democrat look like a complete fool, with what just happened in England. But don't expect it, the GOP seems to lack the balls to do something like that. I bet right now some scumbag Repub is meeting with a scumbag Dem to discuss how this ruling "shouldn't be politicized".
Liberal judges are the tools of tyrants, the Democratic party are the tyrants, the MSM are the agitators for the tyrants, and yellow bellied and opportunistic Republicans are their lapdogs (all the while pretending to be the guard dogs of the Republic).
Where are the true, couragious conservatives? Oh yeah, they are so slandered and hammered by our press that they cannot get elected.
She was appointed in 1979, so it would have had to have been Carter.
Not to be terribly racist or sexist, but who would have guessed that the traitor in question would be a 2-fer on the affermative action scale?
I don't care anymore. Let tens of thousands of us die in American cities before the inevitable move must be made.
Jimmy Carter? ACLU? The AP and Reuters must be tied into this? LOL!
Is Diggs a member of the ACLU?
