Huntsville AL: Police say hands tied by federal priorities

A Huntsville police officer sees a car run a red light and pulls the driver over. At the wheel - holding a smudged, crudely printed green card - is obviously an illegal immigrant. The officer writes a ticket, climbs back in his patrol car and drives away. What's wrong with this picture?

Plenty, if you're on the side of America's immigration debate that believes being here illegally is reason enough to be arrested and deported.

Nothing, if you're a law enforcement officer coping with today's maze of federal laws, limited jail space and other demands on your time.

In fact, the scenario above is how Huntsville police officers routinely handle encounters with illegal immigrants here, officials say. None has been taken into custody based on routine police encounters, Police Chief Rex Reynolds said. That's a big surprise to a lot of people.

Nonsense. The officer lets the person go because his local Govt doesn't want to be bothered with the problem. So 10s of thousands of possible border enforcment agents are removing themsleves from being part of the solution by claiming the "Feds aren't leting us deal with this" instead of doing their job.

This is typical behavior of HPD. I know cause I live in Huntsville.

The car has no business being operated until a licensed driver is behind the wheel.

The police officer was remiss in his duty to let that car be moved.

Why write a ticket to a person with a green card, just a waste of ink. The car should have been impounded. Where did the tags come from.? who allowed tags on a car driven by an immigrant? Where was his proof of insurance? Where was the title to the car who owns it? How can a green card prove a car wasnt stolen?

You may nopt be able to arrest the immigrant, but you can damned sure make certain he dosnt drive that car away.

I realize that there time constraints on the officer. The irony here in these situations is that law abiding citizens will be punished for speeding, and illegal aliens may ignore the law. The minimum that should be done is to take the subject to a station, and run his fingerprints to compare with State and Federal records, if possible. If this is not possible, he still needs to be photographed and fingerprinted, and then cited, with his thumb print on the back of the citation. These people shouldn't be let go without being officially documented by photos and prints.

And you cannot ALLOW the illegal driver to continue driving illegally. He may walk home while, as you said, the car is impounded. Problem partially solved.

Other half of problem: deport illegal alien immediately. Impound his a$$ until deportation proceedings. Fine same. Genuine Gov't "green cards" are not crudely printed.

Let's see if we have this correct: Illegal aliens are above the law while true citizens must continue paying taxes, obeying the law and paying the price for our transgressions, have I got it right so far?

Since you live there, you need to ask the important question
"How many of these people pay the fine or show up in court? It should be a matter of record. How many "failure to appear"
does Huntsville have? You and I can't drive around Huntsville without a license or insurance. It's a good bet that the person running the red light didn't have insurance either. In most states thats a serious crime also. They wanted to be police officers so they should inforce the law on all not just
on citizens.

There can be no excuse for allowing an unlicenesed driver to drive off in an automobile.

Its the same as allowing a drunk driver to drive on home after getting a ticket.

I agree, however down here in Birmingham the police did exactly that after an unlicensed, uninsured driver (with dealer plates on the vehicle) rear-ended my wife's car a few years ago. The perp was Mexican - don't know if they were legal or not.
