Court Ruled DeLay's Name Stays on Ballot

A federal appeals court on Thursday refused to let Texas Republicans replace Tom DeLay's name on the November congressional ballot.

The 5th U.S. Circuit Court of Appeals upheld a ruling by U.S. District Judge Sam Sparks, who said in July that DeLay's name had to stay on the ballot even though he quit Congress and moved to Virginia.

DeLay won a March primary before resigning from Congress on June 9. He is awaiting trial in Texas state court on money laundering and conspiracy charges alleging that illegal corporate cash helped pay for legislative campaigns in 2002.

That is what the law says and, unlike NJ democrats, republicans don't have a bought and paid for judiciary here.

Of course. He just has to reverse everything that he did that he said made him a resident of Virginia. Which isn't much.

If he's gotta be on the ballot, he may as well run.

When he wins, then he can resign if that's what he wishes.

Delay's arguments were based on the US Constitution, that Delay wasn't going to be a resident of Texas.

So, Delay wins, having his name on the ballot, then the Democrats go to court and sue because he is not a Texas resident-correct?

In the end, doesn't this mean a special election, one that Lampson is going to lose anyway?

Federal election law issue probably. The jist is that Delay put himself on the primary ballot, won the primary, and then decided to not run in the general election. He then wanted the state party to pick a candidate to replace him. I am inclined to agree with the courts. If the decision was made to allow the person who came in second to take his spot, I don't think it's as much of an issue. But the will of the voters is being denied here in the sense that the primary is totally being called off.

It would be like a beauty pageant being held, the winner disqualified, but the runner up not being given the crown, but a friend of the organizer.

The disarrayed GOP in the House desperately needs a different leader. They're all over the place. Run, Tom run !

The RINO's are isolating the conservatives. The President isn't paying much attention domestic-wise to either the House or Senate, preoccupied as he is with the chaos in the ME and hot spots around the world.

Tom would be a big help to the Prez and a gift to us all. He has the energy and the know-how to LEAD.

I'll be waiting with bated breath to see if he starts campaigning right away. If and when he does, I'll open a bottle of wine and have some soft brie spread on a crispy cracker.

He was at the time of the primary.. so at the time he intended to run he was a resident. Hense the ruling.

It's got to be a state issue, unless Congressmen are treated differently from Senators. Remember that Toricelli withdrew only days before the election, and the Dems were allowed to substitute someone else.

Well, I don't believe the will of the voters is ever thwarted in a primary. It is the party that chooses to have its candidates decided by a primary. They could use straws as far as I'm concerned.

The Toricelli situation was different because that deadline was practical -- time to print ballots, etc. There's no such assertion here.

I think it's very simple. Delay should apply to get in-state tuition for a UT course from his address in Virginia. He won't get it.
