Most likely an empty threat.
I am not too worried lol. Especially since everything that beed discussed is in the public record. But I would suggest to these compnies that they might instruct their spokeswomen not to be speaking in their name about lawsuits because people are asking questions and talking about the what is in the public record. That can be horribly misconstrued.
Thank you for that interesting link. It sounds like there is some discrepancy in what Ms. Otis-Fred is saying and what Texas claims regarding their status.
Now: Have the civil suits, judgements and garnishment against Michael Fred and American Caging been discussed? I see that Ms. Otis was his attorney for at least one in 2002.
Relevant, or not?
I could tell this was faked, because there's much more fence in that picture than the MinuteMen have built.
That might be. To be honest I need to go back and look at those 2002 suits. If I recall correctly I dont think she represented him. In fact I think it is true that as to what happened in the County where American caging is located no one representing American Caging or them personally ever showed up in anything. I seem to recall that someone submitted a document later into the record that proved the family home was a homestead and therefore couldn't be used under Texas law as a part of a judgment
As to the corpoartion matter. In the end that is not major really. I guess it could become major if it is not corrected I was told all they have to do is pay backtaxes and reapply and its over. Currently though the State of Texas through the two people I talked to this past week and from what I saw today were talked to by a poster on another forum today that there is no if ands or buts they are not a legal corporation.
As to the liens I don't know the status of that. However that can be found out.
The discovery process is probably the main factor that will prevent lawsuits, but if everything quoted is backed up by public records, I don't know that any competent lawyer (hmmm, that might be a problem...) would take the case, except as a form of harassment, because there's no chance of prevailing.
Most likely an empty threat.
That's SOP.
They begin with insults and implications of liberalism. If that doesn't work, they imply everyone is ignorant but them (but offer no details to explain why), and when all else fails, they threaten legal action.
It's become so predictable as to be almost amusing. However, we can understand why most of the media consulting is done for losing candidates and these non-profits that seem to deliver nothing but contributions and mailing lists.
Another good point made is that it has now been 14 days. Where is the Washington Times retraction you said would be coming, EV?
Now what was it I was saying just up the thread?
Oh, yeah, this:
http://www.freerepublic.com/focus/f-news/1676828/posts?page=97#97
Maureen Otis, president and founder of ACI: "Since the day MCDC was incorporated, my company has acted as the comptroller and escrow agent..."
Chris Simcox: "The leadership of the Minuteman Civil Defense Corps and its officers continue to have full faith and confidence in American Caging, Inc.".
.
.
.
This was filed 8-1-06, totaling $29,929.11:

If this has already been discussed, I missed it and would like to know what other opinions were voiced or facts learned.
Ms. Otis is an attorney and former CPA, and is "founder and president" of ACI. Michael Fred is also a founder, and responsible for collecting the mail from the various p.o. boxes each day.
Being named in several civil suits, judgements and garnishments does not seem to affect their business, as we see with MCDC, Keyes.org, and other clients.
Well all that is indeed interesting as well as all the other civil problems. I think its important for several reasons and legitimate to least think about
I really doubt that this caging firm is skimming off the top or doing anything blantant like that. But again what can't help but notice when the syndicate shows up often they are there.
The reason I find that interesting it it does raise the question that perhaps that certain people are getting lets a refund of the money they contribute to caging fees. I think that is something valid to explore because that company is making a ton there and its weird that we should be seeing problems such as this
Pannell Kerr Forster of Texas,P.C. (report): "There are two types of bank accounts that ACI will deposit funds into on behalf of its customers-an account where ACI has signatory authority to sign checks drawn on it, and an account with no signatory authority by ACI.
For accounts with ACI signatory authority, ACI performs the following functions:
.....Prepares checks drawn on the organization's bank account to disburse funds to the organization....the organization's fundraiser....or ACI.
----
So ACI can prepare and sign checks to be disbursed for MCDC and its fundraisers (people, orgs)---and pay themselves?
Most nonprofits would be concerned about any company whose owners are named in lawsuits, judgements and garnishments, especially when there is some question about the records and filings of that business, and knowing the nature of their business and high profile clients will bring on much attention.
That is true. And they hace certain high profile clients. It is a touchy issue because we do know they went through a divorce. However I must say they must must still get along pretty well if Mr Fred is still working there picking up the mail and God knows doing what else.
But you are right. There is a weirdness to all these suits and unpaid taxes on such things as Condos and the Xerox corporation suing Caging because no one has paid the bill in a year.
That's certainly what she said.
I'm sure someone will be along shortly to tell us why that's not what she meant....
You are absolutely 100% correct, on all accounts!
I used to think that was especially true of self-proclaimed Christian conservatives.
Sadly, some of them don't seem to practice what they preach.
More Trouble In Minuteman Land-- Power Struggles, Envy, Pettiness, and Sex
http://theponderingamerican.blogspot.com/2006/08/trouble-in-minuteman-movement.html
"..CHRIS SIMCOX @ MCDC SAID: Minuteman Project "founder" Jim Gilchrist is about to lead his band of volunteers to the slaughter in the Laredo area beginning September 11th. MCDC does not sanction this suicidal plan of Gilchrist's -he does not have the support of land owners, law enforcement and Border Patrol as he claims. It is imperative that all MCDC volunteers stay away from this dog and pony show disaster in the making. We begin our fall MCDC border watch along the entire southern border just as we always do on October 1. We will be deployed in new areas in all four southern border states during our fall operation. We have new equipment and many new volunteers, but we must stick with MCDC and steer clear of the Gilchrist, Texas Minutemen, Glen Spencer American Border Patrol radicals. We can only pray for them and hope they do not self destruct, get someone killed and ultimately tarnish the Minuteman movement -even if they do, we shall rise above by sticking with our SOP and rational game plan. We will conduct our operations as we always do in order to assist law enforcement and with the safety of our volunteers as a primary operational concern..."
"..MM01: Now you stab Gilchrist and Spencer and TXMM in the back...
SIMCOX: Have not stabbed anyone in the back -I come at you head on. Gilchrist, Spencer and TX Minutemen would never pass inspection with MCDC. All are extremist, racialist radicals. Gilchrist should have been the first person terminated from the April '05 month long project for violating the SOP.???? It was Jim who started the Minuteman Project operation not you, you are delusional.."
If Simcox is quoted accurately he really has turned on Gilchrist. It especially bad that he is playing the racist card against Gilchrist.
