IMO you just may be wrong with your assumptions.
President Bush, as often said, is playing CHESS and the SCOTUS, MSM, Democrats, Specter, et al are playing CHECKERS.
Why? If, G*d forbid, we have another terrorist attack on this country, the Democrats, SCOTUS, Specter, MSM, et al will look like the "weak on terror" fools they really are.
President Bush is doing everything he can to protect the citizens of this country and is being undermined by every liberal and some conservatives. The SCOTUS decision to grant Geneva Convention status to terrorists was the most blatant support of terrorism in this century. This decision will come back to bite the US in the butt and GWB will probably say, "I could have told you so".
If he doesn't, he should.

no, that will not work. because the president doesn't take a message to the people expressing outrage over these attempts.
americans don't want geneva protections for terrorists, and americans support the foreign intelligence wiretaps. the president could easily take a message to the people on these two issue - but he doesn't, he doesn't want to fight the apparatus of the left (the courts, the RINOs in the senate) that are defeating him on these issues.
so if a terror attack does occur, he won't be able to back and say "I told you so" - because he isn't telling anyone anything up front, he's just giving in to this.
