I think it is more likely that they go to court to have him exhumed so they can confirm that he is really dead.

If the family is smart, because of the inevitable kook and conspiracy theories that are already emerging about his death (some on this website), they will have him cremated as soon as possible.
Of course, that will be seen by the kooks as evidence of a cover-up.
