True, and Rs in Congress could very quickly defuse the whole issue by passing legislation that explicitly affirms the right of the administration to use military tribunals for all scumbags at Guantanamo. Intelligent legislation rapidly moved through would put the Demagogues right back on the defensive and uphold the obvious rational national interest. This should not have been necessary under Article II of the US Constitution and with past wartime precedents for military tribunals. It is an inappropriate dilution and restriction for executive authority to have to go to Congress on this issue. Also, with milquetoasts like Arlen SPECTRE and other RINOs around, I hope that the legislation does not get all fouled up in the Senate Judiciary Committee, etc. Hoping that the R. leadership finally has the 'nads to do the right thing, and quickly!!

I think this is only the beginning of this fight with the courts. It will take weeks, if not months, for Congress to get the legislation, and the debate should be heating up right about . . . October??
