WASHINGTON (CNN) -- The U.S. Supreme Court on Thursday ruled that the Bush administration did not have the legal authority to go forward with military tribunals for detainees at the Guantanamo Bay military base in Cuba.

The 5-3 ruling means officials will either have to come up with new procedures to prosecute at least 10 so-called enemy combatants awaiting trial, or release them from U.S. military custody.

The case was a major test of President Bush's authority as commander in chief in a wartime setting. Bush has aggressively asserted the power of the government to capture, detain, and prosecute suspected terrorists in the wake of the 9/11 attacks

Guess they'll just sit there then, until the end of the war. Shame. President: "Gee, I'd love to adjudicate their fates but SCOTUS say I can't." So they'll sit and rot and the President can rightly claim he's got no choice. Now the ball in is Congress' court.

You got that right. What unit commander can afford to have soldiers collecting evidence and writing affidavits? None. The loss of strength is too high. A policy of no prisoners will be the only viable one. SCOTUS just signed the death warrants for people they think they were protecting. Nice move, asshats.

We (our military) needs to give the same orders Comrade Putin (aka; the Rooskies) issued fo taking care of those in Iraq who killed the four Russians in Iraq - just KILL 'em when they're found! Take no prisoners!
