There you have it! Merkel was right in adressing this issue with President Bush. You need to find a solution for the dilemma.

Key words Michael - "without congressional approval."
The Supreme Court did not say the trails were wrong all together. They basically are defining the limits of executive powers.

There is a whole plethora of reasons why what Bush is doing is OK. The people at GITMO are unlawful combatants. Unlawful combatants is not a euphemism to circumnavigate the law. It's a term that applies to non-uniformed, fighting under the no flag, without any laws or rules, maximizing collateral damage, targeting civilians..... Terrorists! If we want, we can "argue" that the RAF were soldiers and fighting a war as well. No, they were nothing but terrorists. A bunch of thugs who would define themselves as soldiers but in reality use methods to terrorize people to get to their end.
Frankly if you as a soldier take off your uniform what could the enemy do to you if caught? What standard are we to apply to terrorists? Some in your country, even der Spiegel, avoid using the word "terrorist". Think about that!
The whole debate over GITMO is absurd. In WWII most of these people would have gotten hung and no one would have cared. These "terrorists" today are to be afforded more privileges and rights than the leaders of the NAZI state at the Nurnberg trails (And while as evil as they were, they were under a flag, they did largely follow the rules of land warfare....)!
No longer in uniform I can state what I really think - A bullet is cheap. I admire your GSG9 and what they did some years ago in Bad Kleinen.
