This distinction gives Mexico the right to look down its nose at us.

They waited after he was executed to complain.
A few years ago there was a suspected murder from California in jail in Canada. The US wanted him, the Canadians balked. The US said fine, go ahead and keep him. When he gets out he will be roaming Canadian streets. The SC of Canada said to the US, Please take him.
If Mexico ever complains again, the US or Texas should say okay, we will deport him to Mexico City under darkness. See how they would like that.

And there lies part of the primary reason Mexico has gangs running around shooting up the locals with impunity in places such as Nuevo Laredo and the police force in that city basically no longer is able to "protect the people". They cannot even protect themselves.
There are many needed fixes for Mexico, IMO, and this one change would certainly be a step in the right direction. However, the country is far too corrupt to see this happen, at least not likely in my lifetime.
