The libs tried to get him and failed they are hoping to nail him while he is on probation.

He's not on probation. Probation is a sentence subsequent to conviction. Rush has not been indicted.

He's in a diversion program; if he complies with the conditions of the deal, the charges will be dropped without ever going to court and he will have no record.

There was some howling at the time about Rush getting a "sweetheart deal." I checked with my dad, who's worked in the Georgia Department of Corrections for about 36 years, and he told me these diversion arrangements are pretty standard for first-time, non-violent offenders who aren't at high risk to re-offend. It's not in anyone's interest to put them into the system.

Well, I just think he should've done what folks are expected to do and carry the scrip. But if he was that worried about being embarrassed, though I can't for the life of me see why, he should've just left it home.

I think you're considering "transfer" in the wrong terms. It is illegal for people to distribute prescription drugs to others for use or consumption. But it is not illegal for a person to purchase and carry (essentially acting as an agent) prescription medication for another.

I suspect that your correct regarding the use of the word "transfer".I routinely picked up my Dad's prescriptions when he was living with me.

But assuming that we're both correct on this matter,is what happened with Rush (assuming that the news report is accurate) a crime? Did the doctor involved "transfer" the drug to Rush in a way that violated state or Federal law (drug laws,laws that regulate pharmacy practices,etc) or laws (or "standards") concerning the practice of medicine.

So who,if anyone,is in trouble here? Rush? The doctor? Both?

As a Christian Conservative, I have a major problem with putting people that have major weaknesses in places a leadership. I am no expert, but I don't think that they do search every single plane. If that were the case, I'm sure Rush and the other men with him would have known to take care of this minor problem before they landed.

I'd bet that the MSM will try to fan the flames with this story, but it's very like the Ann Coulter voting story. Both are very big public targets, and the necessary precautions must be taken. I read an article two weeks ago here on FR that was actually a sit-down interview with Ann Coulter, done by a female British journalist. Excellent interview. One of the most striking things I learned is that Ann has a stalker that the FBI classified as a Level One. The kind of stalker that murdered John Lennon. Common sense would dictate that Ann does not give out her address.
Michelle Malkin had to move her family in secret only a short time ago because of threats to her family.

The prosecution that became a costly persecution of Rush Limbaugh is what this story is all about...that Nifong wannabe prosecutor down in Miami is still intent on seeing Rush jailed for something...anything, it seems. Somebody ought to be taking a good, hard look at that guy.

You must have missed one of the posts. Viagra isn't only used for, well, you know, it is also used in cases of pulmonary hypertension.

Please get off the judgment seat. No one is perfect and everyone doesn't have your sense of right and wrong. Maybe you could try praying for Rush instead.

IMHO, you are in a bit of a corner here, one can not have prescibtion drugs in their possession, that are not prescribed for/to them....a bottle of prescription drugs, with a label for DR. J. Doe, it just that, medicine for the use of Dr. J. Doe.

There are two separate issues: Whether Rush had a legitimate prescription, which he apparently did, and whether his name was on the bottle, which it apparently wasn't.

As long as he had a legitimate prescription, even if it was filled in a fake name, he's not on the hook for illegal possession. It would be like checking into a hotel under a fake name -- something celebrities do all the time -- as long as you're not doing that to get out of paying for it, no harm done.

As far as I know -- and I'm not a lawyer or a pharmacist -- if I have a legal prescription for 25 Vicodin, and I have 25 Vicodin with someone else's name on the bottle, I'm not breaking the law. It's not like each tablet is stamped for one person's use. Not illegal, but it does raise eyebrows in Customs.
