Who decides when discretion should be used? Who decides what person gets a pass and what person does not get a pass?

Cops do it everyday - so do judges and so do juries. If a cop gets called to a house that is being too loud, he could charge the occupants with disturbing the peace or he could just warn them. The same with a speeding violation and countless other offenses.

The Rush would have been better off being pulled over by the cops. CBP does not give that authority to CBP Officers.
