Rush Limbaugh's Attorney Roy Black Responds to Media Inquiries

MIAMI, June 26 /PRNewswire/ -- Roy Black, Rush Limbaugh's attorney, issued the following statement today in response to several inquiries by the media:

While going through routine Customs inspection of luggage at Palm Beach International Airport upon his return from an international trip, Rush Limbaugh was detained by customs agents after they noticed a non-narcotic prescription drug, which had been prescribed by Mr. Limbaugh's treating physician but labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes. After a brief interview, Mr. Limbaugh was permitted to continue on his journey.

Thanks for the clarification. I know my priest said that if you are sick in the hospital and dying, if you want to see me, have someone call me, because the hospital is not allowed to tell me you are there. This is a crock of you know what. Let's pull Bobby Kennedy Jr. off a plane and see what he has.

Just curious, who else would have alerted the media?

It's an honest question, I have no clue about the chain of command here. I'm assuming Rush was subject to extra scrutiny (based on the fact that I have never had my pills checked on any flight I have taken) but this may have been for reasons other than celebrity (where the flight was coming from, maybe his past problems put him on a watch list).

Once the prescription with the doctor's name is found in his bags, and they ask the questions and decide to notify the local law enforcement and let him on his way, who would notify the media? The DA's office? The CBP?

Agreed. A world traveler like Rush should have known he'd be subject to a luggage search upon return. I'll be interested to hear what he has to say tomorrow, if he addresses it at all.

Is it legal to have a prescription in your Doctor's name for privacy reasons? Sorry, not a lawyer...

There are at least two questions here: 1) was Rush in lawful possession of the drug, and 2) was the medication labeled properly? Judging from Rush's lawyer's statement the answer to the first question is yes, to the second question, no.

The follow-on question to the second question is, if the medication was improperly labeled, who is responsible? The answer is, whoever labeled it. It would appear that Rush's doctor labeled it. If so, he might get his hand slapped--and even then a skillful defense attorney should be able to defeat the charge (to keep this post short, I won't get into the details of how a defense might proceed).

In either event it looks like Rush is in the clear.

To answer your question more precisely and narrowly, there is no "privacy defense" to drug labeling law violations.

I wonder... If any of us were rich and had that much popularity, how would we be able to get prescriptions? Sure at the usual pharmacy they have all the info already, you send someone to get it for you; But what if you're in the Dominican Republic? If you left yours and called your doc, would he call it in and you personally have to get it... or would he get it to you some other way?

Rush is Public Enemy #1 insofar as the foaming-at-the-mouth Left is concerned. He needs to be very careful. If true, this sounds like he may not have been careful enough. The jackals are ever on the hunt.

Everyone is assuming Rush had it for a male potency problem but originally Viagra was introduced and used for a heart muscle problem by both men and women. I sure hope Rush's Dr. didn't need to try him on Viagra for this purpose but it would be a slap in the eye for whoever decided to detain him because of it.

Why does the media know about this? Someone there talked that is why, He was targeted. A celeb getting off a first class flight does not get such scrutiny. That smells here in flyover country. Don't know about the left coast. If it walks like a duck, talks like a duck, then it's a duck. At least in the majority of this country. Rush needs Viagra, he's impotent. That's the angle. Period.
