I have known of several families who put the house in the husband and his mothers name. Then the wife and the children are helpless and SOL. California state law allows that. Texas has the homestead law which protects the spouse. Florida has a similar provision. It's all predicated on what state law says since it's not a fed issue.

Knew a Lebanese guy who tried to pull that one--but it doesn't work like that in Texas.
