Ninth Circuit Decides: The Mt. Soledad Cross Will Come Down, "Memorial Would Be Desecrated"

ANN ARBOR, MI A threejudge panel of the Ninth Circuit Court of Appeals has refused to stay Federal District Judge Gordon Thompsons order to remove the Mt. Soledad Cross pending an appeal. Thus, the City of San Diego must remove the Cross by August 1, 2006, or face fines of $5,000 per day thereafter. In its decision, however, the Ninth Circuit scheduled oral arguments on the matter for the week of October 16, 2006, weeks after the Cross is to be removed. The 43- foot Cross was erected in 1954 and currently is the centerpiece of a national memorial honoring American veterans of all wars. The Thomas More Law Center, a national public interest law firm based in Ann Arbor, Michigan, has been fighting to save the Cross since 2004 when it received information that the private memorial association operating the memorial site and the City were about to agree to settle the case, which had been on going for 15 years, by removing the Cross.

The separation of powers gives other branches of government the clear right to ignore the courts. Sadly there have been few executives with the conviction to do so.

Agreed. A huge human wall protecting the cross. That would make a huge statement.
Your friendly neighborhood cops would rather crack your skull wide open then risk their paychecks. Get in their way when they go to desecrate the cross at your own peril.

The fact that one person, "from another part of the City" is able to force this on San Diego somehow makes it even more obscene.

The city owns most of the land, apparently, & the Association is managing the Memorial(s). The
Mt. Soledad Memorial Association site says that they "Purchased land in 1999 at the top of Mt. Soledad, now the site of Veterans Memorial Walls.", which leads me to believe that the Cross (which is actually their Korean War Memorial) is situated on City land?
