TX doesn't have any kind of homicide provision for a death that occurs during the commission of a felony? I'm pretty sure Texas does. Not sure why it wouldn't be applicable in this case unless some idiot prosecutor looked at it as if the little girl's death was accidental and homicide wasn't intended.
