Can you call tomorrow to help score the first 2006 victory?

Dear MoveOn member,

Tomorrow is Election Day in California's 50th Congressional District, where progressive Francine Busby is looking for the last few hundred votes to win.

The national Republican Party has spent over $4 million desperately trying to beat her. They've even tried to drive a wedge between Busby and us by mentioning your work in one of their ads.1 We're not going to let that happen. So together, we're redoubling our effort.

Despite all the Republican attacks, the election is a "dead heat just 48 hours before voters head to the polls..."2

This weekend, MoveOn members made over 30,000 calls to progressive voters. We need to call another 10,000 Busby supporters tomorrow to put Busby over the top. Tomorrow's calling is especially important. Studies show that a reminder to vote can have a huge impact. Turnout is usually low in special elections like this, so the voters we contact could make all the difference.

I'm calling from move-un and if you don't vote for Busby we'll call the INS.

I heard that the immigration and nationalization service employees will now be operating as undercover poll workers... /8?)) Anyone else hear that? May have been just a rumor.

Federal tax law prohibits 501(c)(3)s from “intervening” in any election for public office, federal, state or local. The IRS has interpreted this to mean that a 501(c)(3) organization may not support or oppose a candidate for any elected public office. Not only does this prohibit 501(c)(3)s from explicitly endorsing or opposing any candidate for office, it also prohibits any activities that would reasonably appear to be efforts to support or oppose a candidate implicitly. Thus, 501(c)(3)s must typically avoid activities that identify candidates who share or oppose the organization’s positions on policy matters or that label candidates in ways likely to generate support or opposition for the candidate such as describing the candidate using code words that suggest support or opposition such as “liberal” or “conservative.” The IRS evaluates possible “electioneering” by 501(c)(3)s based on a case-by-case examination of all of the “facts and circumstances.” Not only the language of a particular communication, but also the audience, timing, past history of the organization, current debate among the candidates, and other factors will be considered in determining whether the 501(c)(3) has violated the ban and “intervened” in an election.

Unless they are supporting a democratic candidate; then it is called "free speech"........
