Thing is, depends on when his grandparents crossed into the US whether or not they were illegal. It's conceivable they came in the very earliest part of the 20th Century, before the type of immigration laws with which we are familiar were enacted. Most immigration laws were previously focused on how long it took to become a citizen, not only mere residency.

In 1921 the first quota law was enacted.
