The other problem with immediate deportation is that each and every one of the deportees is entitled to a court hearing. I live near the Mexican border and I see the Border Patrol picking up border intruders by the dozens. They process them quickly and bus them back to the border. There is no court hearing. None.

Those are people who are caught in transit and don't have a job. Those who are already here, when caught, can request a hearing and plea for a green card, on the basis of being already employed.
