Another Scam? (the troops have no arrest or detention powers - only for one year)

A Polipundit reader has reviewed the Goode Amendment - the "send troops to the border" provision and discovered some disturbing facts: The troops amount to one soldier with one current border patrol agent

the troops have no arrest or detention powers

THEY WOULD ONLY BE STATIONED AT THE BORDER FOR ONE YEAR.

Here is the pre-amble;

“To amend title 10, United States Code, to authorize the Secretary of Defense to assign members of the Army, Navy, Air Force, and Marine Corps, under certain circumstances and subject to certain conditions, to assist the Department of Homeland Security in the performance of border protection functions.”

Sounds good right?

OK, here is the dirty little secrets.

“(d) Conditions of Use- (1) Whenever a member who is assigned under subsection (a) to assist the Bureau of Border Security or the United States Customs Service is performing duties at a border location pursuant to the assignment, a civilian law enforcement officer from the agency concerned shall accompany the member.”

So, each military member will simply now be a buddy for a Border Patrol guy.

Now look at this;

“(2) Nothing in this section shall be construed to–

(A) authorize a member assigned under subsection (a) to conduct a search, seizure, or other similar law enforcement activity or to make an arrest;”

So, the military has nada authority.

BUT it gets better;

“(h) Termination of Authority- No assignment may be made or continued under subsection (a) after September 30, 2007.’.”

This is a ONE YEAR DEAL!!!!!!!!!!!!!!

If this is not a replay of the 1986 Act I do not know what is.

Posse Comitatus act means the President or the military can't do this on their own but congress can authorize it for a specific action.... the first draft of this ammendment is just a particularly lame authorization

Sounds like it doesn't it? If this is the plan why don't they just finance the Minuteman Project, if funding and wages were available many more would join MM, and it sounds like the military won't be allowed to do any more than the MM can do.

I would say at this point...the Bush administration is useless and should be treated as such. And I would toss both the senate and congress into the same pile.

So the agenda for the rest of the year? Minuteman patrols to continue, and increased. Ask each senator and congressman running to sign a pledge to fix the problem...if they don't...then don't vote for them. Better to have a democrat in office who can carry out the public's need...than a Republican who goes onto Blitzer's show and talks big...and never does a single thing. Its also time to target the border states, and their legislatures...and boost up the state budget for border patrol and control. If AZ has to build a wall...then so be it. Forget about Bush and the polititicans...they will be useless from this point on. They are as appreciated as FEMA in a hurricane.

Thank you. If those are means tested benefits, sponsors of legal immigrants would be sued to collect the costs. It's a shame that they're being served up to illegals.

Sentinel TMS looks interesting, as I am working with UNIX systems and sometimes learn a thing or two about security.

Do you want to know what ticks me off the most about this whole issue? Well if you don't hit the back button right now.

Here's what it is. The Federal Government really has very few Constitutionally mandated functions. I mean ones which are actually specifically enumerated. One of them is to secure the borders and most specifically see that the several States are free from invasion.

This responsibility is spelled out infinitely more clearly than any Federal authority to regulate oil companies, run a national retirement plan, finance medical care for the citizenry, pay subsidies to interest groups, or even disaster aid.

These 535 clowns we sent to Washington can't even read a 4 page long document and follow a simple set of written instructions without f****** it up. And it's not that one can truly say they're f****** it up. They aren't even trying!

The US Dept of Agriculture can track every single cow in America from cradle to grave but with multiple Departments, Agencies, Bureaus, the entire weight and might of the US Government can't get a handle on 11 to 20 million people who refused to comply with a pretty simple set of rules and just walked across an open border.

It's not like they're hiding or anything. They're right out there, in the open marching around and demanding stuff from us by the tens of thousands. And nothing is done about it. Oh they popped a couple of business owners for the tv cameras in the last week and 'rounded up' a couple hundred violators but they very quietly let them go later.

Other than that, nothing.

Those idiots in Washington can't get one of the 4 or 5 things they're actually Constitutionally mandated to do right, but they've got all the time in the world for farm policy, trade policy, oil policy, paying off Federal contractors etc etc etc.

And did I forget to mention we're at WAR. At least 10 million screaming sons of mohamet are howling for American blood the world over, some of whom have access to some pretty sophisticated means of killing large numbers of people, and we're leaving the back door to the entire Nation open and unlocked!

Now is it just me or does that sound oh...I don't know...maybe just a little bit....insane?

OK. I'm done. Rant off.

Well it was a little like a rant; but I totally understand your frustration- believe me!!

Ranting aside I agree with you. It is the responsibility of the Federal Government to protect our borders and it is clearly spelled out in the Constitution. Most other issues politicians concern themselves with are not mandated by the Constitution and I for one would be happier if they stayed out of many of those other issues.

I think our borders should have always been secured and if there really was or is a need for workers from other countries a system should have been set up years ago to really deal with that in a legal manner- since that was not done we need to take action now to secure the borders and fix the related problems.

As you said, we are at war right now, our troops are in danger every day with the main idea of protecting this country and it's citizens- while little is done at home to assure the same.

It was truly, one of the best speeches in US history, imho.

I thank God that sKerry lost the election, but he is still a danger (as is the rest of the RATS in the Senate), because he still opposes any type of defense of this nation. And has an influence through his vote, when he shows up and is not undergoing botox injections.
