New York millionaire Robert Durst now must report twice a month instead of daily to his parole officer and no longer is subject to electronic tracking of his movements around the Houston area, his lawyer said.
"Bob is just a normal parolee now," defense attorney Dick DeGuerin said Monday.
Durst was acquitted of murder in November 2003 . He admitted cutting up Galveston neighbor Morris Black's body and dumping the parts in garbage bags into Galveston Bay in September 2001.
State officials said Monday a routine review of Durst's parole status resulted in Durst's reduced reporting requirements and removal of an electronic monitoring device. DeGuerin said he believes the Texas Board of Pardons and Paroles relaxed Durst's restrictions in hopes of avoiding a federal court ruling on Durst's claim that he lived under rules harsher than those imposed on people convicted of nonviolent crimes.
Durst is on parole after pleading guilty in 2004 to felony evidence-tampering and bail-jumping charges that stemmed from Black's death.
"It was done after a customary 60-day review that showed Mr. Durst had been on the electronic monitoring for 63 days without any incident," Michelle Lyons, spokeswoman for the Texas Department of Criminal Justice, said of the change in Durst's parole plan.
"The restrictions placed on Mr. Durst were never meant to be unfair or harsh," Lyons said. "They were based on his performance on parole, which, up until December, had not been ideal."
But DeGuerin said: "I think they're doing it to avoid an adverse judgment in the federal court, but we're still going to press for that. They put him on these restrictions without justification."
Durst also wants to get a ruling in the federal case in hopes that others who believe they are subjected to unfair parole restrictions by the Texas board will have a precedent case that might help them, DeGuerin said.
Word of the changed parole rules came from a document filed last week in U.S. District Judge Lee Yeakel's court by Reed Lockhoof, an assistant state attorney general, DeGuerin said.
Durst, who has been on parole since July, was arrested Dec. 20 for taking unauthorized trips to Galveston and Houston's Galleria, places that were not on his approved itineraries at the time.
A former Galveston neighbor reported seeing Durst outside his former home there.
Durst also had an awkward encounter with Galveston State District Judge Susan Criss, who presided over his murder trial, when the judge was Christmas shopping at the Galleria.
In January, the parole board put Durst in an intermediate detention facility for 60 days as punishment for those infractions.
Durst was released March 1 and remained under the same daily reporting and travel requirements that his attorneys had asked the federal court to remove, on grounds that Durst was receiving unequal treatment under the law in violation of the U.S. Constitution.
Lyons said Durst will be free to travel throughout Texas without getting permission from his parole officials.
Durst, who turned 63 on April 12, lives in Houston. His parole is scheduled to end Nov. 29.
Durst is a member of a family that owns 10 skyscrapers in New York City, among other properties. He recently severed ties with the family real estate empire, taking $65 million in the deal, according to the New York Times.

You can only hope that if you ever got in trouble you would get someone to defend you with his talent. Durst is the scumbag here, not Deguerin.
Because he has gotten off many guilty persons, including murderers. He may be brilliant at gaming the system, utilizing loopholes, and manipulating gullible fools on juries, but that didn't produce justice. Quite the opposite.
Then blame the Prosecutor for not doing his job. OJ went free not because of his defense attorney, it was the lack of credibility on the prosecutors.
