Didn't Terry Nichols do a plea bargain to get the death penalty off the table? I don't recall that he was ever accused of being present for the bombing, but I may be forgetting crucial details....

I believe the implication is that the death penalty IS permitted for terrorists...I have to find the statute to absolutely prove it, but this definitely suggests it.

Yes, you can even use RICO to ensnare the terrorists. Sometimes, I have heard the Judge not state the CURRENT state of the law. (I am a NON-PRACTICING attorney myself)..I do not claim that I am up to speed on all the various facets, but I try to keep up as best as my day job allows.

I see your point in that parenthetical. That to me is another reason the civilian courts are not the proper forum. I still believe that Terrorism has been granted special status, but I'm going to have to actually look up the law and I don't have time to go to the Patriot and recent terrorist statutes...I think that's not complete.
