A leading legislative critic of illegal immigration said Monday that he's willing to shape key parts of new legislation against illegal immigration in ways intended to help get it signed by Gov. Janet Napolitano, who has already threatened a veto if one possible provision is included.
Formal introduction of the legislation being assembled by Rep. Russell Pearce and other Republican lawmakers for consideration by the House has been delayed while lawmakers work out its provisions.
Pearce, a Mesa Republican, said he's willing to have a provision dealing with increasing the National Guard presence on the U.S.-Mexico border changed so that the governor isn't mandated to order a deployment once she declares a state of emergency like the one now in force.
"It is a compromise on my part. There are still people that want it (the mandate) in so I'm not sure I'll win that battle," he added.
Napolitano earlier this session vetoed a bill on the National Guard on grounds that the Legislature shouldn't tread on the governor's power as the National Guard's commander in chief.
Pearce also said he's willing to not include making illegal immigrants' presence in Arizona a crime under the state's trespassing law. Napolitano vetoed a previous bill to do that, and she has threatened to veto the new measure if it includes a similar provision.
"I don't want to send something that is begging for a veto," he said.
Instead of expanding the trespassing law, the new legislation could achieve virtually the same purpose by directing police to ask about legal status when questioning people or taking them into custody for other reasons, Pearce said.
"I'm not asking to charge them with anything. They're already in violation of the law. I just book them and put a hold on them for ICE (Immigration and Customs Enforcement)," Pearce said. "Once you've determined they're illegally in this country, you have authority to arrest."
Pearce noted that Georgia's governor last month signed a sweeping immigration bill that requires police to check the immigration status of people they arrest.
"I would add it to the Miranda warning (as) the last part of the Miranda warning, are you here illegally?" Pearce said, referring to the statement of rights which police officers recite to arrested suspects.
Sen. Barbara Leff, a Paradise Valley Republican who sponsored the vetoed trespassing bill, said she didn't know whether it would be included in the House package and said Pearce appeared to be near-unilaterally setting the Legislature's course on the issue.
Pearce said the still-developing package still may be presented as an entirely new bill, though nearly all of its provisions have been included in previous bills. Another option is to amend the package onto one of the previous bills.
"We're running out of time," he said. "We still have bills out there hanging (but) I'd rather send up one bill."
I'm tired of hearing that Americans are heartless because if enforced our laws would separate families. Funny...I thought it was the Mexican Government who was instigating that kind of separation, while lucratively benefitting from the millions of pesos the "guest workers" send back to their families in Mexico. My Mother-in-law used to send welfare packages back to Italy, too, and probably a little money occasionally. But she was a LEGAL alien who annually registered her whereabouts at the local post office!

She is pig headed, will veto anything remotely favorable towards cracking down on illegal immigration, and will not stand for anyone telling her "how to do her job."
November 7th can't come soon enough. I hope she doesn't get too many bruises on her fanny when she lands on it that day, on her way out of office.
Russell Pierce is the Arizona taxpayers best friend in the State House! The change his is agreeing to really does nothing to the overall effect of the bill, it just puts more pressure on Nappy to sign it. Bravo Russ!AWB

Just WHAT is the matter with AZ voters that they vote for clowns like Napolitano and McCain??? I guess the citizens have no choice but to patrol the wide-open border themselves, since the governor can do nothing but issue emergency declarations that don't amount to a bucket of warm spit.
What is her GOP opponent like? Is he another RINO disappointment like McStain?

Families can be together in Mexico or what ever third world flop house they came from. The American family should be the only ones considered by our government or it is no longer our government.
Yesterday proved the enormous expense to our education system by the presence of illegals that don't finish school anyway.
They can go flunk out in Mexico or what ever third world flop house they came from, just as well as they can flunk out here, and at no cost to the U.S. taxpayer.
I'm not too thrilled with the thought of another woman governor after what the last three have done. However I believe that Jan Smith Florez, has the best chance of beating Nappy. I spent a little time questioning Jan, I think she will probably be a good Governor, much better than Nappy.

"These funds provide our law enforcement community with another valuable tool to fight crime related to illegal immigration."
