A woman whose doctors refused her infertility treatment because she is a lesbian has sued before California's Supreme Court, her attorney said.
"Our client's doctors' behavior goes against established medical ethics and violates California civil rights law," said Lambda Legal attorney Jennifer Pizer in a statement announcing the suit was filed on Monday.
"The doctors claim a right not to comply with California's civil rights law because they are fundamentalist Christians and they object to treating a lesbian patient the same way they treat other patients," the group said in a statement.
An appeals court overturned a trial court decision that Guadalupe Benitez was denied infertility treatment in violation of California law.
"Doctors are supposed to treat their patients, not make religious judgments about them," Benitez said in a statement.
"I trusted my doctors and then they humiliated my family and me by refusing to perform the insemination procedure after they'd been treating me and promising it to me for nearly a year," she said.

Why didn't she just get another doctor? Was she trying for an immaculate conception, of sorts?
No freedom of choice for this doctor!
They should have rejected her request up front, instead of waiting a year. Having said that, she should have shopped another doctor, or even gone the DIY route, there are websites out there that will tell her how to use a turkey baster, seriously.
Article starts with "infertility treatment", then at the very last it changes to "insemination".
It looks like they have treated her "infertility", so why doesn't person just go on and get laid?
This is the part where the story becomes fuzzy.
My guess is that perhaps, for nearly a year, she kept it a secret that she was a lesbian. Otherwise the Catholic doctors wouldn't have given her the time of day.
My other guess is that she deliberately set this whole thing up just to bring this case forward to the public and the courts.
The questions will be asked: so why did you go to Catholic doctors when you know what an ABOMIATION your lesbian lifestyle is to them? Why did you ask for something you KNOW they wouldn't do?
Smells like a set-up to me. I think it stinks of the ACLU.

She doesn't want her case swept under the rug.
I think the doctors should have continued treating her......(but never actually "succeeding")......This way they would still make the money and the lezzes would not have known to go to another clinic.......
How about she just try having one the old fashioned way. Wait, I forgot about that new "right" that everyones seems to think they are entitled to have children whenever they want.

I can understand doctors being obligated to administer life-saving treatment. This, however, does not qualify. No one's life is in danger here, and there is no reason to force the doctors to act against their consciences.
