Right now, it's not required.
I'm thinking that making it a requirement was part of the Senate bill that Frist wanted to introduce...but I may be wrong.

Make it required.
Make local law enforcement bound to arrest illegals.
Take away Federal funding to cities that declare themselves sanctuaries.
