Because, the Senate is currently debating making them NOT criminals (as opposed to all other criminals), in case you missed that.
When a law is broken a criminal is made. Changing the law so that what they did was not a criminal act is hardly something that could be called constitutional.
Unless of course you care to have ALL laws be retroactive in that way.
